Land Use Management Ordinance Text Amendment – Modification to the Planned Development-Housing Minimum Land Area Requirement in Residential Districts

PURPOSE

 

Enactment of the attached ordinance would change the Land Use Management Ordinance provisions to allow a reduction in the minimum land area requirements for a Planned Development-Housing to allow multi-family development to occur on a lot that is at least one acre in size, if located in a residential conditional use zoning district. 

RECOMMENDATION

 

Following the 2003 enactment of the Land Use Management Ordinance, the Council adopted a goal of considering adjusting the minimum land area requirement for multi-family development occurring as a Planned Development-Housing in a residential district from five acres to one acre.  The proposed adjustment provides a cautious approach to achieve the Council’s objective of consideration of this change.  Although we recommend that the land area requirement be reduced from five acres to one acre, the provisions require that the property be located in a residential conditional use zoning district.  This would typically require a zoning change and provide the Council with the legislative control associated with the anticipated rezoning. 

 

I believe the proposed changes to the Land Use Management Ordinance would benefit the community by creating more options for redevelopment within the Town.  If the Council is concerned about changes from a five acre minimum land area to a one acre minimum size with the prerequisite conditional zoning district, the Council may choose to insert a three acre or larger minimum land area instead, as desired.  A three acre minimum land area was recommended by the Planning Board.

 

My recommendation is that the Council enact the attached Ordinance, approving the proposed Land Use Management Ordinance text amendment which would change the Land Use Management Ordinance provisions to allow a reduction in the minimum land area requirements for a Planned Development-Housing to allow multi-family development to occur on a lot that is at least one acre in size, if located in a residential conditional use zoning district.
