subject:     Reschedule of Public Hearing: Woodmont on NC 54 East: Zoning Atlas Amendment, Master Land Use Plan, and Special Use Permit Applications

BACKGROUND

The Woodmont applicant (Capital Associates) has requested that the Council reschedule its public hearings on these three applications from April 21, 2008 to May 12, 2008, to provide the applicant an opportunity for the applicant to present additional information to the Planning Board.

The applications affected by this request are as follows:

Zoning Atlas Amendment – Conditional Rezoning: The proposed rezoning application is to rezone a 34.19-acre site from Residential-2 (R-2) and Neighborhood Commercial (NC) to Mixed Use-Village (MU-V).

Master Land Use Plan: The proposed Master Land Use Plan would allow 573,300 square feet of mixed use floor area on the 35.54-acre site.

Special Use Permit: The proposed Special Use Permit application is to construct Phase I  of a mixed use development with 183,900 square feet of floor area with 404 parking spaces on a 10.3-acre site.

RECOMMENDATION

I recommend that the Council adopt the attached Resolution to reschedule the public hearings for the Woodmont applications to May 12, 2008.

By rescheduling the public hearings for the Woodmont applications, the deadline for submittal of a protest petition is also delayed. If a sufficient protest petition is filed with the Town Clerk at least 2 business days prior to the date of the public hearing, the proposed rezoning(s) shall not become effective except by favorable vote of not less than three-fourths of the Town Council.
