RESOLUTION

(Denying R-HD3-C Rezoning)

 

A RESOLUTION DENYING AN APPLICATION FOR A ZONING ATLAS AMENDMENT FOR THE RESIDENCES AT GROVE PARK (Orange County Property Identifier Numbers 9788-49-4924, and portions of 9788-49-1706, 9788-39-4941, and 9788-39-4857)

 

WHEREAS, the Council of the Town of Chapel Hill has considered the application of Ram Development Company, to amend the Zoning Atlas to rezone property described below from Residential-4 (R-4) and Residential-6 (R-6) to Residential- Higher Density 3-Conditional (R-HD3-C) zoning, and fails to find that the amendment:

  1. corrects a manifest error in the chapter, or
  2. is justified because of changed or changing conditions in the area of the rezoning site or the community in general, or
  3. achieves the purposes of the Comprehensive Plan.

 

For the reasons that:

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council hereby denies the application of Ram Development Company to amend the Zoning Atlas to rezone the property identified as below:

 

SECTION I

 

That the site, identified as now or formerly as Orange County Parcel Identifier Number 9788-49-4924 and a portion of 9788-49-1706, that are currently zoned Residential-4 (R-4) located along Hillsborough Street. The description of the property is as indicated on the attached metes and bounds rezoning map [368 KB pdf]. 

 

SECTION II

 

That the site, identified as now or formerly as portions of Orange County Parcel Identifier Numbers 9788-49-1706, 9788-39-4857, and 9788-39-4841 that are currently zoned Residential-6 (R-6) located along Martin Luther King Jr. Blvd. The description of the property to be rezoned is as indicated on the attached metes and bounds rezoning map [368 KB pdf].
