REVISED ORDINANCE B

AN ORDINANCE AMENDING THE CHAPEL HILL LAND USE MANAGEMENT ORDINANCE REQUIREMENTS TO ADJUST FLOOR AREA RATIOS IN THE RESOURCE CONSERVATION DISTRICT (2008-05-05/O-4b)

WHEREAS, the Council of the Town of Chapel Hill has considered the proposed text amendments to the Land Use Management Ordinance to adjust floor area ratios in the Resource Conservation District and finds the amendments are warranted in order to achieve the purposes of the Comprehensive Plan including to protect the natural environment;

NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Chapel Hill as follows:

Section 1.  Section 3.6.3 (f) (1) of the Chapel Hill Land Use Management Ordinance is hereby revised to read as follows:

“In lieu of dimensional regulations generally applicable to the General Use Districts, the following standards shall apply to the Resource Conservation District, for use except public greenways and necessary public utilities.  The floor area ratios shall not apply to uses associated with an approved Special Use Permit, unless modified otherwise by the Town Council.”

Section 2.  That the amendments shall become effective upon enactment.
