WHEREAS, the North Carolina Department of Transportation (Department) and the Town of Chapel Hill (Municipality) have a mutual interest in the efficient and effective operation of traffic signals on the system serving Chapel Hill and Carrboro; and
WHEREAS, the provisions of the North Carolina General Statutes 136-66.1 and 136-18 authorize the Municipality to contract with the Department for the installation, repair and maintenance of highway signs and markings, electric traffic signals and other traffic control devices on State Highway System streets in Chapel Hill and Carrboro; and
WHEREAS, the Municipality has agreed to maintain and operate the traffic signals on State Highway System streets within Chapel Hill and Carrboro, subject to reimbursement by the Department as set forth in the Agreement; and
WHEREAS, the Department and the Municipality propose to enter into a revised agreement including updated reimbursement rates for the maintenance and operation of traffic signals on State Highway system streets in Chapel Hill and Carrboro; and
WHEREAS, the revised agreement shall cover the period from July 1, 2008, through June 30, 2009, with mutually agreed upon extensions being made in one (1) year increments, up to a total duration of five (5) years;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Town Manager to execute an agreement between the Town of Chapel Hill and the North Carolina Department of Transportation including reimbursement rates for the operation and maintenance of field traffic signal equipment at Level of Service C.
