Ms. Merck,

 Thanks for your email. Capt. Kelly informed me earlier today that you had called to discuss this issue and request a re-review of the sprinkler requirement from Town Code on this project.  I have looked again at Town Code 7-56 (3), and have again confirmed that this section does apply to the renovations proposed at 109-111 E. Franklin St.  This issue was reviewed by the Town’s Attorney on 8/26 for official interpretation of the application of this code section.  He concurs that this code section will apply based on building value. 

With regard to #1 below, the official record of building value used for this basis is the tax value as posted by the Orange County Land Records.  This information is available for your review at http://gis.co.orange.nc.us/land/queries/account.asp?PIN=9788375329 and is based only on the assessed building value.  The building value on this property, as documented from this link, is $688,438.  Your building permit application proposes $350,000 of renovations, which is greater than 50% of the building value and therefore initiates sprinkler requirements under Town Code.

 It is important to understand that this requirement is from local ordinance, and is in addition to any NC Building Code requirements described in #2 below.  The provisions described here are under my understanding, to meet the criteria for application under the NC Rehab Code, for which you are requesting review under.

 I appreciate the concern regarding your application; however I have reviewed the Town Code and have conferred with Town Staff who are all in agreement that Section 7-56 (3) is applicable to your proposal and will require the installation of fire sprinklers.

 I wanted to follow up with our conversation today about the re-review of the Vanilla Box Plans for 109-111 East Franklin Street.

 As you reviewed with me on Tuesday about the Town Ordinance 7-56 stating, “(3)   In a non-residential building of more than six thousand (6,000) square feet which is either renovated at a cost greater than fifty (50) per cent of value or which is damaged and rebuilt at a cost greater than fifty (50) per cent of value.”

 I just wanted to state the reasons why we feel we are asking for the re-review. 

1.      The building is above 6,000 sf but our building though the tax records states $688k the building is worth $1.9 million per our client.  I would be happy to get you any paperwork you may need to help you with understanding this which would keep us well below the 50% mark. 

2.      Also, I would like to add all the measures we are implementing in this phase of permitting is for Life/Safety.  WE are adding many features:

a.       area of rescue assistance call stations

b.      2 hour fire ratings between  floors and tenants

c.       Fire rated stairs

d.      New operable windows on the second floor

e.       Smoke detectors

 I would say 80% of this permit is focused on the safety and welfare of others and have actually gone beyond State Building code guidelines to provide tenant spaces that provide a safe environment for these tenants.  Please feel free to call myself of Marc Christopher here at Phillips regarding this at any time with any additional questions or feedback.  We would like to get through this process with all parties agreeable and would appreciate any consideration you could give us in reviewing this manner.
