subject:       Public Hearing: Aydan Court, 2100 NC-54 East, Zoning Atlas Amendment and Special Use Permit Applications

PURPOSE

Tonight, the Council holds public hearings regarding requests from Cazco, Inc. for a Zoning Atlas Amendment and a Special Use Permit for Aydan Court. Tonight’s public hearings have been scheduled to receive arguments in support of and opposition to the Zoning Atlas Amendment application and receive evidence in support of and opposition to the Special Use Permit application. The purpose of this cover memorandum is to forward my preliminary recommendations to the Council.

The Zoning Atlas Amendment and a Special Use Permit applications for Aydan Court are associated with a Land Use Management Ordinance Text Amendment, to amend the allowed intensity of the Residential-Special Standards-Conditional (R-SS-C) zoning district, on which the Council may take action October 27. Approval of the Aydan Court applications is dependent on enactment of the R-SS-C Land Use Management Ordinance Text Amendment.

Manager’s preliminary recommendation

I have no preliminary recommendation at this time. The Comprehensive Plan contains some conflicting values that are challenging to balance at times. In particular, the Aydan Court site is environmentally sensitive but also located on a major transportation corridor, prompting higher density development considerations. Input from the public and the Council at the hearing will inform the ultimate preliminary recommendation.

I recommend that the Council open the Public Hearings and receive comment regarding both Aydan Court applications: 1) the Zoning Atlas Amendment, the applicant’s request to rezone the site from Residential-1 (R-1) to an amended Residential-Special Standards-Conditional (R-SS-C) zoning district and 2) the Special Use Permit application to construct multi-family dwelling units.    

We will return to the Council with a preliminary recommendation for action after the Council has received public comment and evidence this evening and reconvened the hearing.
