subject:      Continuation of Public Hearings: Residences at Grove Park, 425 Hillsborough Street Zoning Atlas Amendment and Special Use Permit Applications

PURPOSE

Tonight’s meeting is a continuation of the November 24, 2008 public hearings for a proposal by RAM Development Company for the Residences at Grove Park Zoning Atlas Amendment application and the Residences at Grove Park Special Use Permit application.  The purpose of this memorandum is to recommend that the Council delay consideration of the Zoning Atlas Amendment and Special Use Permit applications to the Council’s January 12, 2009 business meeting.

DISCUSSION

The Residential-Special Standards-Conditional (R-SS-C) zoning district is proposed to be amended and is scheduled for the Council’s consideration on November 24, 2008.  Because the Residences at Grove Park applicant it proposing a rezoning to the Residential-Specials Standards-Conditional district, it is necessary to delay consideration of the rezoning and Special Use Permit application until such time the Council acts on this proposed text amendment.  Once the amendments to the Residential-Special Standards-Conditional zoning district are finalized, we will be able to complete our evaluation of the Residences at Grove Park applications.

The applicant is currently working with an adjoining property owner on resolving issues related to a Protest Petition with the rezoning application.  The applicant hopes to resolve this matter prior to the January 12, 2009 hearing.

RECOMMENDATION

We recommend that the Council adopt the attached Resolution to continue the public hearings for the Residences at Grove Park Zoning Atlas Amendment and Special Use Permit Applications to January 12, 2009.
