Title of Agenda Item: Authorization to Complete Amendment #3 to the Development Agreement between the Town of Chapel Hill and Ram Development Company
Background: The attached staff memorandum includes background information on a proposed Amendment #3 to the Development Agreement between the Town of Chapel Hill and Ram Development Company.
Fiscal Note: No fiscal impact is anticipated.
Staff Recommendation(s): That the Council adopt the attached resolution authorizing the Town Manager to execute the “Third Amendment to and Assignment of General Development Agreement” between the Town of Chapel Hill, Ram Development Company, and 140 West Franklin LLC; including conforming changes to the Ground Lease reflecting this assignment, as well as changes necessary for compatibility with the Council’s decision on the Special Use Permit for this project.
