ORDINANCE

(Rezoning to NC-C zoning)

 

AN ORDINANCE AMENDING THE CHAPEL HILL ZONING ATLAS FOR THE 1609 EAST FRANKLIN STREET OFFICE DEVELOPMENT (Orange County Parcel Identifier Numbers:  9799-04-7995 and 9799-04-6951)

 

WHEREAS, the Council of the Town of Chapel Hill has considered the application from Coulter Jewell Thames to amend the Zoning Atlas to rezone property described below from Residential-5 (R-5), and a portion zoned Residential-1 (R-1)  to Neighborhood Commercial-Conditional (NC-C), and finds that the amendment is warranted, in order to achieve the purposes of the Comprehensive Plan;

 

NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Chapel Hill that the Chapel Hill Zoning Atlas be amended as follows:

 

SECTION I

 

That the site, identified as now or formerly 9799-04-7995 and 9799-04-6951 currently zoned Residential-5 (R-5), and a portion zoned Residential-1 (R-1) located at 1609 East Franklin Street between Elliott Road and Couch Road, shall be rezoned to Neighborhood Commercial-Conditional (NC-C) and that the area to be rezoned shall also extend to the center of the right-of-way along the site’s frontage on East Franklin Street.  The description of the portion of the property to be rezoned is as indicated on the attached legal description.

 

SECTION II

 

That all ordinances and portions of ordinances in conflict herewith are hereby repealed.
