A RESOLUTION CALLING PUBLIC HEARINGS TO CONSIDER VARIOUS AMENDMENTS TO ARTICLE 5.5 OF THE LAND USE MANAGEMENT ORDINANCE (2009-01-26/R-8)

 

WHEREAS, on July 10, 2008, House Bill 2580 was ratified by the North Carolina General Assembly that would allow the Town to make changes to the Town’s Land Use Management Ordinance related to payments in lieu of Recreation Area and Recreation Space; and

 

WHEREAS, in order for the legislation to be effective the Council must modify the Land Use Management Ordinance; and

 

WHEREAS, Town staff have identified other potential changes to Article 5.5 of the Land Use Management Ordinance that could provide greater clarity and improve the effective use of resources dedicated to recreation;

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Manager is authorized to draft language for Council consideration that if adopted would revise the Land Use Management Ordinance in a manner generally described in the above January 26, 2009 memorandum and addressing any comments provided by the Council on January 26, 2009.

 

BE IT FURTHER RESOLVED that the Council calls a Public Hearing for 7:00 p.m. on Monday, April 20, 2009, in the Chapel Hill Town Hall, to consider proposed changes to Article 5.5 and certain related definitions of the Land Use Management Ordinance.

 

BE IT FURTHER RESOLVED that the Council calls a Public Hearing for 7:00 p.m. on Monday, June 15, 2009, in the Chapel Hill Town Hall, to consider proposed changes to Article 5.5 related to adding a requirement that non-residential development approved under Special Use Permits be required to provide Recreation Space and/or payment in lieu of Recreation Space.

 

BE IT FURTHER RESOLVED that this matter is referred to the Planning Board, Parks and Recreation Commission, and Greenways Commission for their recommendations.
