Subject: UNC Hospitals Imaging and Outpatient Center - Application for Special Use Permit
Meeting Date: December 2, 2008
Recommendation: That the Council approves the Resolution of approval for a Special Use Permit Modification with revisions as recommended by staff, as follows:
§ Cross Access: Revision that provides for cross access without an easement because the state of North Carolina does not provide easements.
§ Greenway Trail: see cross access stipulation.
§ Stormwater Facilities and Operations and Maintenance Plans: Deletion of stipulation that required an easement (see cross access stipulation).
§ Erosion Control Bond: Deletion of stipulation requiring bond because the State of North Carolina does not provide bonds. Erosion control is overseen by the State Department of Environment and Natural Resources.
§ Occupancy: Revision with clarifications related to plat recordation by the State of North Carolina.

SUBJECT: Development Application: UNC Hospital Outpatient and Imaging Center
Christine Berndt noted that she would prefer a distance greater than 4 feet between the proposed Greenway and building footprint.

Subject: UNC Hospitals Imaging and Outpatient Center – Special Use Permit
Meeting Date: December 4, 2008
Recommendation: That the Council adopt Resolution A included as Attachment 3 in the December 2, 2008 Staff Report with a revision to Stipulation 15 to not require the applicant to relocate the existing bus stop on the eastbound side of Raleigh Road.

SUMMARY OF BICYCLE AND PEDESTRIAN ADVISORY BOARD ACTION
Subject: UNC Hospitals Imaging and Outpatient Center Special Use Permit Application
Meeting Date: December 16, 2008
Recommendation: That the Council adopt Resolution A included as Attachment 3 in the December 2, 2008 Staff Report with the following amendment to Stipulation 15 that the applicant not be required to construct bus-stop improvements on eastbound Raleigh Road, on the far side of Finley Golf Course Road.

Discussion: Bicycle facilities need to be explored on Finley Golf Course Road and NC54. There has been an increase in vehicular and bicycle traffic on NC54 and Finley Golf Course Road over the past few years. Both vehicular and bicycle traffic are likely to increase over time with area development.

SUMMARY OF COMMUNITY DESIGN COMMISSION ACTION
Subject: UNC Hospitals Imaging and Outpatient Center - Application for Special Use Permit
Meeting Date: December 17, 2008
Recommendation: That the Council adopts Resolution A, approving the Special Use Permit additional stipulations, as follows:
ˇ Greenway Trail Extension on Finley Golf Course Road: That prior to occupancy, the applicant shall construct a 10-foot wide greenway/bicycle trail on the Finley Golf Course Road frontage of the site to match the design of the greenway/bicycle trail along Hwy. 54.
ˇ That the Landscape Protection Stipulation be amended to include the following:
That the Final Plans shall not be approved until an arborist certified in North Carolina has submitted and received an approved tree protection plan from the Town Manager that provides significant preservation measures for protection of the critical root zone for the trees on the west side of the site. The plan is to include the location of the building footprint that demonstrates no damage to the critical root zones of the trees in that area.
Additional Concern: Commission members expressed serious concerns that the proposed building is being sited so close to the existing specimen trees that there is a high likelihood that these trees will be irreparably damaged even with tree protection measures such as chain link fencing, fertilization, etc.
