A RESOLUTION AUTHORIZING THE MANAGER TO NEGOTIATE AND EXECUTE A CONTRACT WITH WALTER HOLMES ELECTRIC COMPANY, IN AN AMOUNT NOT TO EXCEED $501,675, FOR THE DESIGN AND INSTALLATION OF ATHLETIC LIGHTS AT VARIOUS TOWN PARKS (2009-02-23/R-8)

WHEREAS, the Town of Chapel Hill solicited formal bids on the Town website on January 15, 2009 and in the Greater Diversity News on January 22, 2009 in accordance with G.S. 143-128 for the Athletic Field and Tennis Courts Relighting Project ; and

WHEREAS, five responsive bids were received and opened on February 5, 2009;

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Manager to negotiate and execute a contract with the lowest responsive bidder, Walter Holmes Electric Company, in an amount not to exceed $501,675 for the design and installation of athletic lights, including the base bid of $205,300 for light installation at Cedar Falls Park fields #2, 3, and 4 and the following add alternates:

BE IT FURTHER RESOLVED by the Town Council that the Town Manager is authorized to provide Walter Holmes Electric Company a total of 30 days in which to submit drawings sealed by engineers showing that the contractor’s poles and light fixtures meet the requirements of the project specifications. The drawings must also demonstrate compliance with the Town’s ordinance related to light spillage.

BE IT FURTHER RESOLVED by the Town Council that the Town Manager is authorized to negotiate and contract with the next lowest bidder, S&S Electrical Construction Company Inc. in the event that Walter Holmes Electric Company fails to submit the required sealed engineering drawings by March 25, 2009.

BE IT FURTHER RESOLVED by the Town Council that the Town Manager is authorized to submit a budget ordinance to transfer $53,616 in payment in lieu of recreation area funds generated by the Spotters Ridge subdivision and $37,000 in payment in lieu of recreation space funds generated by the Greenbridge development to the Athletic Field and Tennis Courts Relighting Project.
