ORDINANCE

 

AN ORDINANCE AMENDING THE CHAPEL HILL LAND USE MANAGEMENT ORDINANCE TO CLARIFY THAT GRAVEL IS CONSIDERED IMPERVIOUS SURFACE OUTSIDE THE WATERSHED PROTECTION DISTRICT (2009-04-15/O-4)

 

WHEREAS, the Council of the Town of Chapel Hill has considered the proposed text amendments to the Land Use Management Ordinance regarding consideration of gravel as impervious surface and finds that the amendments are warranted in order to achieve the purposes of the Comprehensive Plan as it relates to the following major themes:

 

NOW, THEREFORE BE IT ORDAINED by the Council of the Town of Chapel Hill as follows:

 

Following Table 3.8-1 of the Chapel Hill Land Use Management Ordinance, in the Rules for Interpreting Table 3.8-1, statement (3) under the explanatory paragraph for Column K is hereby revised to read as follows:

 

      (3) Gravel surfaces and l  Lakes/ponds shall not be considered to be impervious surfaces.
