SUBJECT: Response to a Petition Regarding On-Street Parking Regulations on Davie Circle

The following report is in response to a petition submitted by Mr. Burton Fox, 808 E. Franklin Street, requesting that the Town Council consider implementing “No Parking Anytime Except by Residential Permit” on Davie Circle. Please refer to the attached map (Attachment 1).
The Manager does not recommend changes to the current parking regulations on Davie Circle.
However, if the Town Council wishes to take action on Mr. Fox’s request for “No Parking Anytime Except by Residential Permit” on Davie Circle, enactment of the attached ordinance would do so.
Mr. Fox, who owns the property at 66 Davie Circle, submitted a petition (Attachment 2) requesting permit parking regulations on Davie Circle that would allow only residents of Davie Circle to park on the street for more than 24-hours at a time.
In 1997 the Council eliminated then existing ‘No Parking Anytime Except By Residential Permit” regulations on the outer side of the Davie Circle loop. Under current parking regulations, on-street parking is prohibited at all times along the inside of Davie Circle; on-street parking is allowed at all times along the outside of the circle. On-street parking is prohibited on both sides of Davie Circle near its intersection with Franklin Street.
DISCUSSION
We conducted field observations at various times on different days. We noted that available on-street parking was often completely occupied on the outside loop of Davie Circle. We also noted that the large majority of the cars parked on the street appeared to be owned by Davie Circle residents or their guests. We did not observe extensive “commuter” parking or “storage” parking.
We prepared the attached survey form (Attachment 3) describing possible parking restrictions on Davie Circle and solicited comments from the neighborhood residents. We distributed 88 survey forms and 43 forms were returned. Of the returned surveys forms, 17 supported, 22 opposed, and 4 indicated no preference to changes in current parking regulations on Davie Circle.
CONCLUSION
In 1997, the majority of Davie Circle residents requested elimination of “parking by permit” restrictions on Davie Circle. Based on our observations and the lack of a clear mandate for change suggested by the mixed survey response, we believe that the existing parking regulations on Davie Circle are reasonable and effective, and best meet the needs and desires of most neighborhood residents and property owners.
That the Council take no action on this petition.
If the Town Council wishes to act on the petitioner’s request for “No Parking Anytime Except by Residential Permit” on Davie Circle, enactment of attached ordinance would do so.

AN ORDINANCE AMENDING CHAPTER 21 OF THE TOWN CODE OF ORDINANCES REGARDING ON-STREET PARKING (2003-10-27/O-7)
BE IT ORDAINED by the Council of the Town of Chapel Hill as follows:
Section 1. Section 21-27.8 of the Town Code of Ordinances, “No Parking Anytime Except by Residential Permit.” is hereby amended by adding the following in appropriate alphabetical order:
“Street Side From To
Davie Circle Outside Entire Loop”
Section 2. This ordinance shall become effective January 10, 2004.
