SUBJECT:       Proposed Schedule for Additional Duplex Discussions

At its February 23 business meeting, the Town Council enacted a series of changes to the Town’s Land Use Management Ordinance.  Of particular interest during discussion was the topic of duplex regulations.

 

As it was taking action to adjust duplex regulations, the Council expressed interest in further discussions on the subject of lot size requirements and maximum structure size limitations.  The Council asked the Manager to propose a schedule for these discussions.

 

RECOMMENDED PROCESS AND SCHEDULE

 

We recommend the following:

 

• Preparation of a Discussion Paper that reviews the Council’s discussion of February 23, and describes the full regulatory context for duplex regulations.  Included in the paper would be description of how recent and current regulations operate in a variety of settings:  in-fill development of individual lots in neighborhoods, new and old subdivisions, expansion and/or reconfiguration of existing single family structures into duplexes, and Special Use Permit projects.  This paper would be prepared and presented to the Council in early May.

 

• Following review of the Discussion Paper, the Council would determine whether to propose additional changes to duplex regulations.  If the Council decided to do so, it would offer direction in May.  This issue would then be addressed with other Land Use Management Ordinance amendment proposals that would be scheduled for a fall Public Hearing.

 

With the Council’s concurrence, we will schedule work as outlined above.  Adoption of the attached Resolution would confirm this schedule.

 

 

A RESOLUTION APPROVING A SCHEDULE FOR FUTURE CONSIDERATION OF CHANGES TO DUPLEX REGULATIONS (2004-03-01/R-9)

 

WHEREAS, the Town Council, on February 23, 2004, amended the Town’s Land Use Management Ordinance to adjust regulations related to construction of duplex dwelling units;  and

 

WHEREAS, during discussion on February 23, the Council indicated interest in future consideration of possible additional adjustment to these regulations;

 

NOW, THEREFORE, BE IT RESOLVED that the Council of the Town of Chapel Hill requests that the Town Manager prepare a discussion paper on this topic, to be delivered to the Council for consideration during May, 2004.

 

BE IT FURTHER RESOLVED that the Council will decide, based on consideration of that discussion paper, whether or not to initiate further adjustment of duplex regulations (such proposed adjustment becoming part of a Public Hearing in fall 2004, on proposed further amendments to the Land Use Management Ordinance).
