SUBJECT: Rejection of Bids for Town Hall Generator Project

Adoption of the attached resolution would reject all bids received for the Town Hall Generator Project. All bids were over the amount in the projected budget for the project.
BACKGROUND
As discussed with the Council during recent Budget Work Sessions, we developed a design for an emergency generator to serve Town Hall in cases of electric services interruptions. Specification were prepared and a request for bids was distributed.
Notice to bidders for the project was advertised on March 18, 2004, in The Diversity News and March 21, 2004, in the Chapel Hill News. At a pre-bid conference on March 30, 2004, several of the attending electrical contractors expressed concern over their ability to bid on the total project, including the civil engineering portions; therefore, the project was re-advertised as a dual bid, either a multi-prime or a single-prime bid. The project was re-advertised in the Chapel Hill News on April 4, 2004, and The Diversity News on April 8, 2004, as a dual bid. Bid opening was held on April 14, 2004. The multi-prime bids were not opened because there were insufficient bids on the civil engineering portion of the bid package. Sufficient bids were received to open the single-prime bids. Progressive Electric, Inc. of Rocky Mount, N.C. submitted the lowest responsive bid of $354,000.
DISCUSSION
The lowest bid received for the Town Hall Generator Project exceeds the projected budget for this project. We are exploring options and will report to the Council in the fall.
RECOMMENDATION
We recommend that the Council adopt the attached resolution rejecting all bids for the Town Hall Generator Project.
A RESOLUTION REJECTING ALL BIDS FOR THE TOWN HALL GENERATOR PROJECT (Bid# P04-107) (2004-06-14/R-11)
WHEREAS, the Town of Chapel Hill has solicited formal bids by legal notice in the Chapel Hill News on April 4, 2004, and The Diversity News on April 8, 2004, in accordance with General Statute 143-129 for Town Hall Generator Project; and
WHEREAS, the following bids were received and opened on April 14, 2004:

WHEREAS, the bid amount exceeds the amount budgeted for this project;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council rejects all bids.
