SUBJECT:       Budget Amendment for Traffic Signal at the Intersection of Airport Road and Northfield Drive

DATE:             October 27, 2004

 

Enactment of the attached ordinance would increase expenditures for FY 2004-05 by $50,000 for providing a payment to the State for a traffic signal at the intersection of Airport Road and Northfield Drive.

The Manager recommends the enactment of the attached ordinance.

BACKGROUND AND DISCUSSION

 

In 2000, the Council approved Chapel Ridge Apartments with the following stipulation:

 

7.         Airport Road Pedestrian Improvements:  That the applicant shall seek approval of (a) some type of median, (b) a center refuge island, or (c) a pedestrian crossing light from the North Carolina Department of Transportation (NCDOT) and the Town Manager, and shall pay for such improvement if approved.  If NCDOT does not provide approval by the time the first Certificate of Occupancy is ready to be issued, then the applicant shall post a payment-of-lieu with the Town in an amount approved by the Town Manager to meet the cost of (a), (b), or (c) above, whichever is greater.  If NCDOT later approves, installation shall be arranged by the Town using the payment-in-lieu.  If NCDOT does not approve one of these alternatives within five years after issuance of the last Certificate of Occupancy, then the applicant shall have no responsibility to pay for the improvements and the payment-in-lieu would be returned to the applicant. 

Please see Attachment 1 for the area map.  The Developer provided a payment-in-lieu of $50,000 in 2003 to meet the above stipulation. We received an e-mail notification (Attachment 2) from the State that they approved a traffic signal with pedestrian facilities at the subject intersection and requesting the payment-in-lieu provided by the Developer. 

 

Enactment of the attached ordinance would increase expenditures for FY 2004-05 by $50,000 to reflect received revenues and costs, respectively, for traffic signal at the intersection of Airport Road and Northfield Drive.

 

 

 

RECOMMENDATION

That the Council enact the attached ordinance that would increase expenditures for FY 2004-05 by $50,000 for providing a payment to the State for a traffic signal at the intersection of Airport Road and Northfield Drive.

BE IT ORDAINED by the Council of the Town of Chapel Hill that the Budget Ordinance entitled “An Ordinance Concerning Appropriations and the Raising of Revenue for the Fiscal Year Beginning July 1, 2004” as duly adopted on June 14, 2004 and the same is hereby amended as follows:
