SUBJECT:       Authorization to Sell Extra Set of Legal Encyclopedia

The attached resolution would authorize the Town Attorney to sell by private sale to another governmental unit, an extra set of a legal treatise on Municipal Corporations in the Town law library.

 

BACKGROUND AND DISCUSSION

 

A few years ago, the Town Attorney’s Office stopped its subscription for updates to its set of McQuillin’s legal treatise, The Law of Municipal Corporations.  Recently, in the course of modifying its contract for legal research services, the Town Attorney’s Office renewed its subscription to that collection.  Rather than just send new updates, the publisher determined that the charges to the Town would be less if it sent an entire new set of this publication.

 

As a result, the Town now has a duplicate set of McQuillin’s.  Although the extra set does not have recent updates, it continues to provide substantial useful research materials on legal matters related to local government.  The Town Attorney believes that the set may be of use to another local governmental agency and proposes to offer it to sale over the North Carolina local government lawyers’ listserve.  The Town’s Library Director believes the 30 volume set would not be useful in the Town’s materials collection.  Offering these books for sale by this method we believe would afford a better opportunity to dispose of them in a useful manner than including them in the Town’s regular auction proceedings.

 

RECOMMENDATION

 

We recommend that the Council adopt the attached resolution authorizing the sale of these books, pursuant to N.C. General Statute 160A-274.

A RESOLUTION AUTHORIZING THE PRIVATE SALE OF A SET OF DUPLICATIVE LAW BOOKS TO ANOTHER GOVERNMENTAL UNIT (2005-01-10/R-5)

 

WHEREAS, the Town Attorney’s Office has an extra set of a 30 volume legal treatise on local government law that may be of use to another governmental agency in North Carolina;

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill, that the Council hereby authorizes the sale of the duplicative set of McQuillin’s The Law of Municipal Corporations, pursuant to N.C.G.S. Section 160A-274, for the best offer made after notice of said sale on the North Carolina local government attorney’s listserve.
