SUBJECT:       Response for Concept Plan Review Request from the University of North Carolina at Chapel Hill re: 200 Finley Golf Course Road

This memorandum responds to a request from the University of North Carolina at Chapel Hill, asking for Town Council review of a Concept Plan Proposal for property located at 200 Finley Golf Course Road (Attachment 1). 

 

We recommend that the Council grant the request for Concept Plan Review.  Adoption of the attached Resolution A would place the 200 Finley Golf Course Road Concept Plan on the January 19 Public Hearing agenda. 

 

BACKGROUND

 

On December 17, 2004, the Community Design Commission reviewed a Concept Plan Proposal from the University of North Carolina to construct an administrative office building at 200 Finley Golf Course Road. The site is located on the west side of Finley Golf Course Road at the intersection of Prestwick Road (Attachment 2).  The proposed development, which requires a Special Use Permit, includes demolishing an existing building and constructing a 16,215 square foot building with 43 parking spaces.

 

The Land Use Management Ordinance requires Community Design Commission review of the Concept Plan Proposal.  A copy of the Community Design Commission Summary comments from the December 17, 2004 meeting are attached (Attachment 3).

 

DISCUSSION

 

The Land Use Management Ordinance requires that all Special Use Permit, Master Land Use Plan or Major Subdivision proposals be subject to a Concept Plan Review by the Community Design Commission.  The Ordinance also requires that any Concept Plan Proposal, meeting minimum thresholds, as specified in the table below, requires Town Council review, in addition to Community Design Review:

Since the proposed project does not meet the minimum land area, floor area or dwelling unit thresholds, Concept Plan Review by the Town Council is not required. 

 

If an application does not meet the minimum thresholds requiring Council review, the Land Use Management Ordinance provides a process for an applicant to request review by the Town Council.  The Ordinance specifies that a request by an applicant must be filed at least fifteen (15) days in advance of a regular meeting of the Town Council.  The Town Council’s decision on whether or not to review the Concept Plan Review is to be rendered at its next regular meeting after receiving a complete request for Town Council review.  The Town Council may determine to review the Concept Plan or it may decline. 

 

We received and accepted the applicant’s materials on December 6, 2004 (Attachment 1).  This memorandum has been prepared for Council consideration of the applicant’s request.  In this particular case we believe that the Council could conduct a Concept Plan Review of the proposed project at the January 19, 2005 Public Hearing.  The January 19, 2005 Public Hearing currently includes the following items:

·   Potential Land Use Management Ordinance Text Amendment for Demolition by Neglect Ordinance in the Town’s Historic Districts

·   Potential Land Use Management Ordinance Text Amendment to Extend the Reservation Time Period for Potential School Sites

·   Empowerment at 229 North Graham Street Zoning Atlas Amendment and Special Use Permit

·   Concept Plan: Castalia at Meadowmont

 

Alternate options available to the Council included denying the applicant’s request or scheduling the item for a future Public Hearing date.

 

RECOMMENDATION

 

We recommend that the Council grant the request for Town Council review of the Concept Plan Review Proposal for 200 Finley Golf Course Road and schedule the item for the January 19, 2005 Public Hearing agenda. 

 

If the Council desires, adoption of the attached Resolution A would place the Concept Plan on the January 19 agenda.  The Council could also amend the Resolution with an alternate date for the Public Hearing.

WHEREAS, the Town of Chapel Hill has received a petition from the University of North Carolina at Chapel Hill requesting Town Council review of a Concept Plan Review Proposal for 200 Finley Golf Course Road;

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Town Manager is directed to schedule Town Council review of the Concept Plan Proposal, for 200 Finley Golf Course Road, for the January 19, 2005 Public Hearing agenda.
