SUBJECT:       Update on the June 10, 2004 Front Yard Parking Petition

The purpose of this report is to present information regarding enforcement of the Land Use Management Ordinance Front Yard Parking regulations along the entire length of Old Pittsboro Road and Coolidge Street. 

 

BACKGROUND

 

The Land Use Management Ordinance Section 5.9.9 defines and regulates front yard parking, and Section 7.6 mandates that any nonconforming parking area in a front yard shall either be eliminated or made to conform to current regulations within six months after the date of notice.

 

DISCUSSION

 

On June 14, 2004 the Mayor and Town Council received a petition from two residents of Coolidge Street requesting that the Front Yard Parking regulations be enforced along the entire length of both Old Pittsboro Road and Coolidge Street. 

 

The Inspections Department implemented systematic enforcement of the front yard parking regulations to bring the properties along the two roads into compliance.  Inspection requests have been received and inspections were conducted to determine compliance by field evaluations. 

 

There were a total of forty nine (49) parcels identified along Old Pittsboro Road and Coolidge Street.  As of February 8, 2005, forty-two (42) were confirmed to have compliant front yard parking.  In addition three (3) properties have been granted an exception to the maximum parking area regulation by the Planning Department as authorized by Section 5.9.9.d of the Land Use Management Ordinance and are also in compliance.  Four (4) properties have been found in violation (by exceeding the allowable area percentage) and have been issued a Notice of Nonconformity which expires this summer.  If these properties are not brought into compliance, we will issue violation notices and seek enforcement through the courts.
