To the Mayor and Council:
At the Feb 14 Council meeting the Sunrise Coalition was granted additional time to prepare a response to HHOC's request for an extension on its $50,000 loan from the Town. We have done so, and will be making a public presentation of our response at the March 7 Council business meeting, at which time we will propose that the loan be extended, but with some additional conditions added to the Performance Agreement document that we believe are appropriate and will facilitate due process as this project
progresses. We feel this additional language will correct the unfortunate situation that has developed where HHOC has positioned itself in such a way as to eliminate the local residents of the area from participation in the planning of their publicly-funded housing development.
The new content we suggest is provided below so that you will have sufficient time to consider its merits before March 7. The changes are incorporated into the proposed Resolution that had bee prepared by the Town Manager and originally scheduled for action at the Feb 14 meeting. Most of the new content is contained in the last three paragraphs.

RESOLUTION AUTHORIZING A MODIFICATION TO THE TERMS OF A PERFORMANCE AGEEMENT BETWEEN THE TOWN AND HABITAT FOR HUMANITY FOR A LOAN FOR THE AQUISITION OF PROPERTY ON SUNRISE ROAD (2005-02-14/R-13)
WHEREAS, the Town has an ongoing interest in the development of affordable housing in Chapel Hill; and
WHEREAS, a goal in the Townıs Comprehensive Plan is to increase the availability of well-designed, affordable, safe, and sanitary housing for all citizens of Chapel Hill; and
WHEREAS, the Town entered into a Performance Agreement with Habitat for Humanity on February 12, 2003, to provide $ 50,000 from the Townıs Housing Loan Trust Fund to Habitat for the acquisition of a 16-acre parcel of property off of Sunrise Road; and
WHEREAS, the Agreement stipulates that the loan may be extended in whole or part for an additional period upon written request to and agreement by the Town Manager. The Town Manager may approve the request if it conforms to Habitatıs plans for developing this property, or the Town Manager may refer the request to the Town Council, at his discretion;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Town Manager to execute an amendment to the Performance Agreement that would amend Section 3. Terms to read:
³Habitat for Humanity of Orange County (HHOC) may have use of this loan for a period of up to three years from the date of this Performance Agreement.
On February 28, 2006, the loan will be repaid in full to the Town of Chapel Hill.
There will be no interest charged on the loan.
The Townıs loan is for the purpose of acquisition of property. Subordination of this loan is subject to approval of the Town Manager.
The Performance Agreement and the loan may be extended in whole or in part for additional periods upon written request by HHOC to the Town Manager and majority vote by the Town Council. In considering such a request, the Town Council will determine whether HHOC has conformed to all resolutions approved by the Town Council for the development of this property, and whether it has responded to the recommendations provided by the Community Design Committee and members of the Town Council during previous public reviews of the project.
During the period in which the loan funds are available, HHOC shall make public disclosure within 30 days of the results of any technical studies, engineering or land use assessments, and significant architectural or other modifications to the original Concept Plan presented to Town Council in October 2004. These may include, but are not limited to, studies of noise, soil, traffic, storm water management, tree save, and environmental encroachment on wet lands and resource conservation districts.
Particular efforts should be made by HHOC to share this information with residents of the existing neighborhoods surrounding the proposed development and to maintain open, ongoing communications with these local residents as the project progresses.
