SUBJECT: Plans for Extending Services to Proposed Annexation Areas

Attached are two resolutions approving amendments to service plans for the Vineyard Square and Larkspur proposed annexation areas.
BACKGROUND
On January 24, 2005, the Council approved service reports setting forth plans for extending and financing municipal services to the Vineyard Square area and the Larkspur area on substantially the same basis and in the same manner as for the rest of the Town. The service plans were prepared in accord with State annexation laws (North Carolina General Statute 160A-47 and other sections).
On March 21, 2005 The Town Council held public hearings on the proposed annexations. No changes were requested to the proposed service plans as a result of the public hearings.
On March 21, 2005, we reported that we revised estimated revenues downward, to use the correct personal and property tax for 2004-2005 of 51.6 cents per $100. We also reported that on April 11, 2005, we would include resolutions for the Town Council to amend the service plans containing these corrected revenue estimates. North Carolina General Statute 160A-49 grants the Town the authority to make changes in the plans for serving the area to be annexed so long as such changes meet the requirements of North Carolina General Statute 160A-47.
DISCUSSION
The amendments to the reports are corrections for accuracy and are not a substantive change as to how services are proposed to be provided to the areas. The content of the service reports continue to be in accordance with North Carolina General Statute 160A-47. Under this statute, the Town must provide major municipal services to the annexation areas “on substantially the same basis and in the same manner as such services are provided within the rest of the municipality prior to annexation.”
We have amended Section IV “Financing of Services” (page 19 of the Vineyard Square Service Plan and page 20 of the Larkspur Service Plan) and Appendix E pages 1, 2 and 5 of each service plan to reflect the correct personal and property tax rate for 2004-2005. Please see Attachments 1 and 2.
Vineyard Square Area
For the 2005-2006 fiscal year, revised estimated costs are $69,555 and estimated revenues are $168,886.
Larkspur Area
For the 2005-2006 fiscal year, revised estimated costs are $29,130 and estimated revenues are $116,918.
The revised estimate for real and personal property revenues and other estimated revenues, is sufficient to pay the costs of extending services to each annexation area.
RECOMMENDATION
Manager’s Recommendation: That the Council adopt the following two resolutions amending the approved service plans for each annexation area.

WHEREAS, the Town Council has reviewed the Town Manager’s report of April 11, 2005, recommending corrections to the Annexation Report;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council amends the Annexation Report of January 24, 2005, as set out in Attachment 1 of the Town Manager’s report of April 11, 2005.

WHEREAS, the Town Council has reviewed the Town Manager’s report of April 11, 2005, recommending corrections to the Annexation Report;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council amends the Annexation Report of January 24, 2005, as set out in Attachment 2 of the Town Manager’s report of April 11, 2005.
