SUBJECT:       Response to Chapel Hill Kehillah Parking Lot Rental Request

This memorandum responds to a May 9 request from the Chapel Hill Kehillah asking for Town Council approval to operate a Park/Ride lot prior to submitting a formal Special Use Permit application for property located at the intersection of Mason Farm Road and Purefoy Road.

 

We recommend that the Council take no action on this request at this time. 

 

BACKGROUND

 

The Chapel Hill Kehillah is located on a two-acre site at the intersection of Mason Farm Road and Purefoy Road in the Residential-4 (R-4) zoning district.  The Kehillah is seeking approval to lease approximately 50 parking spaces on a long-term basis as a Park/Ride lot.  A Park/Ride lot is allowed in a residential zoning district only with Town Council approval of a Special Use Permit.  A Special Use Permit application has not been submitted to the Town for this proposed facility.

 

In a letter dated March 26, 2005, the Chapel Hill Kehillah requested that the Town Council grant expedited processing of its application for a Special Use Permit.  At the April 25, 2005 Town Council meeting, the Council chose not to authorize expedited processing.

 

The Chapel Hill Kehillah Parking Lot Rental Request is on the Town Council Public Hearing agenda as a Concept Plan Proposal for the June 20, 2005 meeting.

 

DISCUSSION

 

In a letter dated May 4, 2005 (attached), the Kehillah has requested permission from the Town Council to allow Kehillah to begin renting spaces at this time prior to the Town’s final decision on the proposed Special Use Permit application.  We do not believe it is possible to lawfully grant approval for the operation of a Park/Ride lot without a Special Use Permit application. 

 

RECOMMENDATION

 

Manager’s Recommendation:  We recommend that the Council take no action at this time on the petition requesting permission to begin renting parking spaces without a Special Use Permit.
