subject: Scheduling a Public Hearing in Response to Petition: re East Franklin Street Business Owners Regarding Use of Sandwich Board Signs

PURPOSE

 

Adoption of the attached resolution would schedule a Public Hearing to May 15, 2006 to amend Section 5.14 of the Land Use Management Ordinance and the regulation of changeable or movable signs (sandwich board signs).  

 

BACKGROUND

 

On May 23, 2005, the Town Council received a petition from several business owners on East Franklin Street (attached).  The petition requested that the business owners be allowed to place “sandwich boards” in front of their businesses.  The petition stated that the proposed use of the signage would be similar to the manner in which sandwich boards are currently used along the sidewalk in the downtown portion of Franklin Street. 

 

DISCUSSION

 

The existing Land Use Management Ordinance regulations permit changeable or movable signage (sandwich boards) in the Town Center-1 and Town Center-2 districts.  We believe that an amendment to the Land Use Management Ordinance, to permit and regulate the use of this type of signage in areas outside of the Town Center zoning districts, is appropriate and reasonable.  While this type of signage may not be suitable for all commercial establishments and properties, we believe that some flexibility in the current regulation is warranted.     

 

We consider the idea of permitting changeable or movable signs outside the Town Center zoning districts worthy of scheduling a public hearing.  In light of the current staff work load we recommend that the Council adopt the attached resolution, which would call a Public Hearing for May 15, 2006, to consider amendments to the Land Use Management Ordinance regarding changes to the regulation of changeable or movable signs.

 

RECOMMENDATION

 

We recommend that the Council adopt the attached Resolution A, which would call a Public Hearing for May 15, 2006 to consider amending the Land Use Management Ordinance regarding changeable or movable signs.
