SUBJECT:       Report on Nuisance Complaint Regarding 720 Lea Court

PURPOSE

This following information is provided upon the request of a Council Member for additional background regarding nuisance complaints for 720 Lea Court.

BACKGROUND AND DISCUSSION

On September 4, 2005, a citizen filed a report with the Police Department alleging unsanitary conditions and code violations at 720 Lea Court.  Additional complaints against the property were received by the Town Inspections Department from two other citizens.

 

The Police Department forwarded its report to the Orange County Health Department-Environmental Health Division. One of the citizens raised the same complaints about this property with the Inspections Department on September 8, 2005.

 

Town inspectors made visits to inspect the property on September 9, September 12, and September 15. The homeowner was informed of violations to Section 9-114 of the Town of Chapel Hill Code of Ordinances that regulates the condition of private property yards. The owner was asked to discontinue open storage of household items in her yard.

 

Other agencies including the Police Department, the Crisis Intervention Unit of the Police Department and the Orange County Health Department, have visited the property in response to the original complaint.

 

The Town Inspections Department has notified the property owner that she has until October 17, 2005 to bring the property into compliance. Should the property remain in violation, a penalty of $50 a day will be assessed until a final inspection confirms compliance.

 

We have attached a report from the Inspections Department, and we will continue to monitor the property and enforce the Minimum Housing Code as legally appropriate.
