subject:Project Ordinance Amendment to Accept Transportation Grants

PURPOSE

The attached resolution and ordinance would amend the budget prepared on June 20, 2005 which included estimates for grants that have now been awarded to the Town of Chapel Hill for the new Town Operations Center.

BACKGROUND

Project ordinances for the Transit portion of the Town Operations Center were prepared on October 27, 2003, and amended on November 24, 2003, June 14, 2004, June 30, 2004, November 22, 2004 and June 20, 2005.  At the time the project ordinances were prepared, the exact amount of some grants was unknown.  The attached resolution would authorize acceptance of two new grants and one amended grant for the Transit portion of the Town Operations Center.  The new grants and the amended grant replace previous grant estimates.  The total project budget remains unchanged at $22,430,076.

DISCUSSION

On July 7, 2005, the Town of Chapel Hill was awarded a grant for the new facility by the Federal Transit Administration in the amount of $1,213,592 for construction of the transit portion of the Town Operations Center.  The federal portion of the grant is $970,874 (80 percent); State funds totaling $121,359 (10 percent) have been requested; and local matching funds of $121,359 are available in the Transportation Department’s capital reserve fund.

On August 1, 2005, the Town of Chapel Hill was awarded a grant by the Federal Transit Administration totaling $4,700,000 ($1,400,000 for the purchase of land and $3,300,000 for construction) for the transit portion of the Town Operations Center.  Of this amount, the federal funds awarded are $3,760,000 (80 percent) and State funds totaling $330,000 have been requested. Local matching funds of $610,000 will be required because the State will not provide matching funds for the land ($140,000) because the land was purchased prior to award of the State’s Moving Ahead grant for this project, reducing the State’s contribution to $330,000 and increasing the Town’s local share requirement to $610,000.  The local matching share is available in the Transportation Department’s capital reserve fund.

In addition, on September 6, 2005, the Town of Chapel Hill also received approval to revise the allocation of funds within the already approved Moving Ahead grant.  The attached amendment reflects the reallocation.

RECOMMENDATION

That the Council adopt the attached resolutions and enact the attached ordinance authorizing acceptance of the above mentioned grants.


A RESOLUTION AUTHORIZING ACCEPTANCE OF A FEDERAL TRANSIT ADMINISTRATION GRANT FOR CONSTRUCTION AND LAND AND AUTHORIZATION FOR THE MANAGER TO APPLY FOR STATE MATCHING FUNDS (2005-10-24/R-4a)

WHEREAS, on August 1, 2005, the Town received notification of a federal capital assistance grant award for land acquisition and construction of the Transit portion of the Town Operations Center totaling $3,760,000; and

WHEREAS, we have local matching funds of $610,000 available in the Transportation Capital Reserve Fund; 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Town Manager is authorized to accept the federal grant for land acquisition and construction of the transit portion of the Town Operations Center and apply for State matching funds in the amount of $330,000.

WHEREAS, on July 7, 2005, the Town received notification of a federal capital assistance grant award for construction of the Transit portion of the Town Operations Center totaling $970,874; and

WHEREAS, we have local matching funds of $121,359 available in the Transportation Capital Reserve Fund;

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Town Manager is authorized to accept the federal grant for construction of the transit portion of the Town Operations Center and apply for State matching funds in the amount of $121,359.

AN ORDINANCE TO AMEND THE CAPITAL PROJECT ORDINANCE FOR A NEW TRANSPORTATION OPERATIONS CENTER (2005-10-24/O-1)

BE IT ORDAINED by the Council of the Town of Chapel Hill that, pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the following grant project ordinance is hereby amended as follows:

SECTION I

The grant project as authorized by the Town Council is for the construction of the Transit portion of the Town Operations Center.  Funds available for this project include local contributions from the Town’s Transportation Capital Reserve Fund and grants and agreements from the Federal Transit Administration and the North Carolina Department of Transportation.

SECTION II

The Manager of the Town of Chapel Hill is hereby directed to proceed with the implementation of the project within the terms of the grant agreements executed with the Federal Transit Authority and the North Carolina Department of Transportation within the funds appropriated herein.

SECTION III

Revenues anticipated to be available to the Town to complete the project are hereby amended as follows:

Amounts appropriated for capital projects are hereby amended as follows:

SECTION V

The Manager is directed to report annually on the financial status of the project in an informational section to be included in the Annual Report.  He shall also keep the Council informed of any unusual occurrences.

SECTION VI

Copies of this project ordinance shall be entered into the minutes of the Council and copies shall be filed within five days of adoption with the Manager, Finance Director and Town Clerk.
