SUBJECT: Consideration of Changes to On-Street Parking Regulations on Oteys Road between Mason Farm Road and Fordham Boulevard

The following information responds to a petition submitted by Mr. Joe Wilber requesting that the time-limit be extended for on-street “parking by residential permit only” on Oteys Road between Mason Farm Road and Fordham Boulevard. Please refer to the attached area map (Attachment 1).
The attached ordinance would extend the hours of parking by residential permit only from 9:00 am-4:00 pm, Monday through Friday; to 24-hours a day, 7-days a week. The parking restrictions would continue to include both sides of Oteys Road between Mason Farm Road and Fordham Boulevard.
We recommend enactment of the attached ordinance.
At its October 10, 2005 meeting, the Town Council received a petition from Mr. Joe Wilber, 1400 Mason Farm Road, requesting that the Council consider extending the time-limit of the existing on-street parking by residential permit only restriction on Oteys Road between Mason Farm Road and Fordham Boulevard. A copy of the petition is provided in Attachment 2.
Mr. Wilber stated that student commuters and the University visitors regularly park on Oteys Road after 4:00 pm, thus reducing available parking for residents upon their return from work at the end of the day. Mr. Wilber also stated that he believes that demand for on-street parking will be further impacted as a result of the University Married Student Housing Apartments planned for construction along Mason Farm Road.
Oteys Road is a paved 20-feet-wide street with no curb-and-gutter or sidewalks. The posted speed limit is 25 mph. Under the current parking regulations, vehicles are permitted to park by residential permit only on both sides of the street between the hours of 9:00 am to 4:00 pm, Monday through Friday.
DISCUSSION
We conducted field observations at various times on different days. We observed a number of drivers parking their vehicles on Oteys Road after 4:00 pm, and leaving the neighborhood on foot.
There are six properties located on Oteys Road between Mason Farm Road and Fordham Boulevard, as shown in the area map provided in Attachment 1. We surveyed all residents/property owners on Oteys Road between Mason Farm Road and Fordham Boulevard, and solicited comments regarding the requested change in on-street parking regulations. Five responses were returned to us, all supporting the requested change in on-street parking regulations. We received no response from the owner or resident of the remaining property.
We agree with the petitioner that the demand for on-street parking on Oteys Road may increase as a result of continuing University development in the area. Based on the survey results and our field observations, we recommend extending the period of regulated on-street parking from 9:00 am – 4:00 pm, Monday through Friday to 24 hours a day, 7-days a week on Oteys Road between Mason Farm Road and Fordham Boulevard.
We will install the appropriate parking regulation signs if approved by the Council.
MANAGER’S RECOMMENDATION
The Manager recommends enactment of the attached ordinance that would change the existing on-street “parking by residential permit only” regulations from 9:00 am-4:00 pm Monday through Friday to 24-hours a day, 7-days a week on both sides of Oteys Road between Mason Farm Road and Fordham Boulevard.

BE IT ORDAINED by the Council of the Town of Chapel Hill as follows:
Section 1. Section 21-27.9 (d) of the Town Code of Ordinances, “No parking anytime except by residential permit” is hereby amended by deleting the following:
“Street Side From To
Oteys Road
Either
Mason Farm Road
Fordham Boulevard”
Section 2. Section 21-27.8 of the Town Code of Ordinances, “No parking anytime except by residential permit” is hereby amended by adding the following in alphabetical order:
“Street Side From To
Oteys Road Both Mason Farm Road Fordham Boulevard”
Section 3. This Ordinance shall become effective November 30, 2005.
