SUBJECT:       Review of FCC 1240 Rate Filing by Time Warner Cable

 

DATE:             January 24, 2000

 

The attached resolution would approve the local cable television franchisee’s maximum rate for basic service for the year 2000.

 

DISCUSSION

 

As discussed in the attached report, the Town’s Consultant on Cable Television has reviewed Time Warner Cable’s FCC filing and supporting documentation regarding its proposed maximum rates for basic service.

 

The Consultant recommends the Council adopt the attached Order finding that the rate request is reasonable and approving the maximum permitted basic service tier rate of $7.77 monthly for Chapel Hill system customers and $12.27 monthly for Durham System customers.

 

Prior to taking action on the proposed order, the Consultant advises that the public must be afforded an opportunity to offer comment on the matter this evening. 

 

Notice of the Council’s consideration of this matter was provided on Thursday, January 20, 2000,  to the local news media.

 

We have extended an invitation to the Consultant to attend tonight’s Council meeting.

 

RECOMMENDATION

 

That Council adopt the attached resolution authorizing the Mayor to sign, on behalf of the Town, the Order finding Time Warner Cable’s 2000 Cable Service FCC 1240/1235 rate methodology as reasonable and approving new basic rates for the 2000 calendar year.

A RESOLUTION AUTHORIZING THE MAYOR OF THE TOWN OF CHAPEL HILL TO EXECUTE AN ORDER ON BEHALF OF THE TOWN APPROVING A BASIC SERVICE TIER RATE FOR CHAPEL HILL CABLE TELEVISION SUBSCRIBERS (2000-01-24/R-14)

 

WHEREAS, the Town Council as received a report from the Town’s Cable Television Consultant reviewing  Time Warner Cable’s FCC 1240 filing and supporting documentation; and,

 

WHEREAS, upon such review the consultant has advised the Town that the data submitted by the cable operator is free of material misstatements and provides a reasonable basis for approval of the proposed rate adjustment;

 

NOW, THEREFORE, BE IT RESOLVED by the council of the town of Chapel Hill that the Mayor is hereby authorized to execute, on behalf of the Town, the attached order approving new basic service tier rates for the calendar year 2000 for Chapel Hill Cable Television subscribers.
