SUBJECT:       Status of Interlocal Agreement on Solid Waste Management

This is a status report on the Interlocal Agreement for Solid Waste Management.

 

BACKGROUND

 

Last fall the owners of the Orange Regional Landfill executed an interlocal agreement meant to govern the transfer of full responsibility for County-wide solid waste management to the government of Orange County.

 

In the original agreement, Section 5 begins:

 

“The Greene tract will remain a landfill asset.  Sixty acres of the Greene Tract will be reserved for solid waste management purposes, and the three owners will work together to determine the ultimate use of the remainder.”

 

Section 5 further states that the zoning of the 60-acre parcel will be amended to allow solid waste management uses, and that the effective date of the agreement will not be before this zoning is in place.

 

DISCUSSION

 

On March 20, the Board of Orange County Commissioners voted to amend the Interlocal Agreement to omit all language regarding the zoning amendment mentioned above.  The Board also voted to withdraw the application for the rezoning of the Greene tract to the Materials Handling zone.  Finally, the Board voted on the precise boundaries of the 60-acre tract to be transferred to the County.

 

A copy of the amendment to the Interlocal Agreement is attached.  Its key points are noted below:

 

  1. The following sentence is added: “The Parties acknowledge and support the County’s position that as operator of solid waste operations, it may, despite diligent efforts to explore alternatives, settle upon the area on and proximate to the existing close landfill site on Eubanks Road as the location for additional solid waste facilities.”
  2. The effective date is postponed to a time later than either the execution of the agreement by the current owners of the system or the agreement by the owners of the exact 60 acres to be transferred to County ownership, whichever is later.
  3. All mention of rezoning the Greene tract to accommodate solid waste management activities is removed. The 60 acres is defined in Exhibit E, which will be available on Friday.
  4. The start of the Solid Waste Advisory Board is amended as are the terms of its members to be consistent with the newly defined effective date.

 

We understand that the 60 acres lie in the northeastern portion of the Greene tract, adjacent to the Neville tract now being used for soil, and the Nunn tract. At this time, we would expect to recommend adoption of this amendment.  However, we will delay our formal recommendation until Friday, when we will be able to distribute it along with a copy of the map of the 60 acres.
