SUBJECT: Calling a Public Hearing on Zoning of
Annexation Area 2

The attached resolution
would initiate a process to zone a newly annexed area in Durham County, once
the Council has adopted an ordinance annexing Area 2 (UNC Property in Durham
County). The resolution would call a
public hearing for June 19, 2000.
This schedule would provide
Council with the opportunity to act on this issue on July 5, 2000, thus
completing the process prior to the Council's summer recess. Chapel Hill zoning must be in place within
60 days of the effective date of annexation of June 30, 2000, or the area will
have no zoning regulation.
BACKGROUND
On January 10, 2000, the
Council called public hearings for March 20, 2000 regarding the annexation of
two areas into the Town of Chapel Hill's corporate limits. On January 31, 2000, the Council adopted
plans for extending services to these annexation areas. On March 20, the Council conducted a public
hearing on Annexation Area 2, and on April 10, the Council considered an
ordinance that would effectively annex this area on June 30, 2000.
This area consists of
University of North Carolina property in Durham County. This area also includes the right-of-way for
a 2100-foot section of Barbee Chapel Road.
This land and right-of-way are on Chapel Hill’s side of the 1986 Durham/Chapel Hill Consent Judgment Annexation Boundary Line, as
modified on August 19, 1994.
Since Annexation Area 2 is
located in Durham County, the Town of Chapel Hill does not presently have any
zoning in effect. When an area is
annexed, if there is no zoning in effect, then zoning must be must be in place
within 60 days of the effective date of annexation or the area will have no
zoning regulation.
DISCUSSION
We propose zoning for the
UNC Property in Durham County in the potential annexation area based on our
review of Chapel Hill's 1989 Comprehensive Plan and 1986 adopted Land Use Plan,
on the size of existing lots, and on compatibility with uses in the surrounding
areas. Based on these criteria, we
propose that Annexation Area 2 be zoned Office/Institutional-2. The adjacent Finley Forest neighborhood
within Chapel Hill City limits is within the Residential - 4 district, which
has a minimum lot size requirement of 5,500 square feet. The adjacent University owned Mason Farm
property is within the Office-Institutional - 2 district, which is intended to provide
for medium-intensity office and institutional development. We propose zoning in conformance with the
portion of the Mason Farm tract adjacent to the western boundary of the
annexation area. The existing Durham
County zoning for the annexation area is Rural Development (RD).
CONCLUSION
Recommendation: That the Council adopt the
attached resolution scheduling the zoning of this annexation area for a public
hearing on June 19, 2000.

A RESOLUTION CALLING A PUBLIC HEARING ON ZONING OF ANNEXATION
AREA 2: UNC PROPERTY IN DURHAM
COUNTY (2000-04-10/R-16)
WHEREAS, the North Carolina
General Assembly has set forth the State's policy that municipalities are
created to provide the governmental services essential for sound urban
development and for the protection of public health, safety and welfare; and
WHEREAS, the General
Assembly has set forth the policy that municipal boundaries should be extended
to include new urban development; and
WHEREAS, the Town of Chapel
Hill's general policy has been to annex areas when they qualify under State law
and the Town can practically extend and finance municipal services to the
qualifying areas; and
WHEREAS, the Town of Chapel
Hill has adopted an ordinance on April 10, 2000, to effectively annex Area 2
(UNC Property in Durham County); and
WHEREAS, the Town of Chapel
Hill does not have zoning for Annexation Area 2;
NOW, THEREFORE, BE IT
RESOLVED, by the Council of the Town of Chapel Hill that the Council calls a
Public Hearing to be held on Monday, June 19, 2000 at 7:00 p.m. in the Council
Chamber of the Chapel Hill Town Hall, 306 N. Columbia Street, for the purpose
of considering zoning Annexation Area 2 as Office/Institutional-2, or an
appropriate related zoning category.
