SUBJECT:       Scope of Work and Schedule for Revising the Development Ordinance

DATE:             August 28, 2000

On July 7, the Town Council selected the firm of Lane Kendig, inc., to assist with revision of the Development Ordinance.  This memorandum proposes a schedule and scope of work for the Council’s approval.  Adoption of Resolution A would set the schedule and start the process.

BACKGROUND

On May 8, the Town Council adopted a new Comprehensive Plan for Chapel Hill.  One of the key recommendations was that the Town’s Development Ordinance be revised to implement many of the objectives of the plan. 

Following review of a set of consultant proposals, the Council selected Lane Kendig, inc., to undertake this task.  Principal consultants working with the Town will be Mr. Lane Kendig and Mr. Dwight Merriam, of Robinson & Cole.  A key feature of the proposed new ordinance is that it will be produced in a web-based, interactive format that Mr. Kendig has successfully implemented elsewhere.

The Town Council has expressed its intention to move expeditiously through the process of revising the ordinance, such that the project can be completed by July, 2001.  The Council also has stated its intent to be involved in the direction given to the consultant, and in review of interim products.

DISCUSSION

We have reviewed the Council’s directions with the consultant, and suggest the following schedule for this project.

Proposed Schedule:

AUGUST, 2000 

·        Seek Council approval of Scope of Work, Schedule

·        Schedule Advisory Board reviews for September

SEPTEMBER, 2000

·        Staff to prepare the following written material to send to each of the following advisory boards, for their review during a meeting in September:

a.      Describe this Task and Schedule

b.     Describe Opportunities for Input

c.      Ask:  (1) What in the existing Development Ordinance needs to be fixed?  And (2) What would you like to see done differently in the Ordinance?

d.     Advisory Boards to approach:

                        Planning Board                         Transportation Board

                        Community Design Commission            Housing Advisory Board

                        Bicycle and Pedestrian Board               Parks and Recreation Commission

                        Historic District Commission                 Greenways Commission

                       

·        Consultant to visit Chapel Hill during September to meet with Town Council (Work Session prior to September 18 meeting).

OCTOBER, 2000

·        Consultant visit to present “Diagnosis.”  This will be a major public meeting, before the Town Council, with Planning Board and other board members invited, with advance notice to public via media briefings, website, mailings.  (Target date:  October 18 Public Hearing.)

NOVEMBER, 2000

·        Consultant to Complete on Annotated Outline of New Ordinance by end of November.

DECEMBER, 2000 – MARCH, 2001

·        Schedule Consultant visit during this period (Work Session prior to January 22 regular business meeting) to review work with Council

·        Town Staff to provide regular feedback/updates to advisory boards

·        First draft of ordinance ready by end of March

APRIL, 2001

·        Public Hearing scheduled to review draft ordinance (April 18, 2001).

MAY-JUNE, 2001

·        Revisions made to ordinance in response to April meetings.  Final product to be presented at June 18, 2001 Public Hearing.

JULY, 2001

·        Council considers adoption of new Development Ordinance.

Proposed Approach and Scope of Work

The Consultant has prepared a document proposing the proposed approach, scope, and schedule of work.  This document is attached, and would become the basis for a contract.

RECOMMENDATION

We recommend that the Council adopt the attached resolution, which would approve a Scope of Work and Schedule for revising Chapel Hill’s Development Ordinance.

A RESOLUTION APPROVING A SCOPE OF WORK AND SCHEDULE FOR REVISING CHAPEL HILL’S DEVELOPMENT ORDINANCE (2000-08-28/R-19)

WHEREAS the Chapel Hill Town Council adopted a new Comprehensive Plan on May 8, 2000; and

WHEREAS the Council set an objective of revising Chapel Hill’s Development Ordinance as one means of implementing the Comprehensive Plan; and

WHEREAS the Council has selected Land Kendig, inc. to assist in the revision of the Development Ordinance; 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council approves a Scope of Work and Schedule for this project as outlined in a memorandum from the Town Manager, dated August 28, 2000.
