SUBJECT: Lake Forest Association Petition

The attached resolution would authorize the Town Manager and the Town Attorney to enter into discussions with the Lake Forest Association regarding its request for Town assistance with the disposal of silt from Eastwood Lake.
At its August 28th meeting, the Council received and referred the attached petition from the Lake Forest Association regarding Eastwood Lake.
The petition notes that Eastwood Lake is experiencing sedimentation problems, and that the Lake Forest Association is contemplating a lake restoration project involving the removal of up to 75,000 cubic yards of silt from the lake bottom. The Association estimates the cost for this work to be between $1.5 and 2.5 million.
The petition requests that the Town either pay the cost of disposal of the lake silt or provide a disposal site at no cost to the Association.
In reviewing the petition, we concluded that the possible implications of our response were both broad and complex. We think that further discussions with the Association and additional consideration by the Town Attorney will be necessary before a reasonable and thorough response can be prepared.
If the Council adopts the attached resolution, we would meet with Association representatives and evaluate this petition request in more detail, and would return to the Council with our recommendations later this fall.
That the Council adopt the attached resolution authorizing the Town Manager and the Town Attorney to enter into discussions with the Lake Forest Association regarding its request for Town assistance with the disposal of silt from Eastwood Lake.

A RESOLUTION AUTHORIZING THE TOWN MANAGER AND THE TOWN ATTORNEY TO ENTER INTO DISCUSSIONS WITH THE LAKE FOREST ASSOCIATION REGARDING ITS REQUEST FOR TOWN ASSISTANCE WITH THE DISPOSAL OF SILT FROM EASTWOOD LAKE (2000-09-25/R-3)
WHEREAS, the Council has received a petition from the Lake Forest Association requesting Town assistance with disposal of silt from Eastwood Lake; and
WHEREAS, Eastwood Lake is a private facility available only for use by Association members and guests; and
WHEREAS, further consideration and evaluation must be given to all implications of this petition request before recommendations can be prepared;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Town Manager and the Town Attorney are authorized to enter into discussions with the Lake Forest Association regarding its request for Town assistance with the disposal of silt from Eastwood Lake.
BE IT FURTHER RESOLVED that the Council directs the Manager to report back to the Council with his recommendations regarding this petition by the end of the current calendar year.
