SUBJECT:            Response to Petition on Truck Parking

DATE:             November 13, 2000

On October 23, 2000, the Council received and referred the attached petition requesting that the proposed Ordinance on parking on private residential lots prohibit the parking of large diesel trucks.  This report responds to that petition.

DISCUSSION

The Ordinance considered and enacted by the Council on October 23, 2000, allows the Council to apply parking restrictions on private residential properties only upon the written request of the owner of the property.  The petition submitted relates to property on which the owner is parking his own vehicle.  Thus, the new Ordinance would not provide a mechanism to address the concerns raised by the petition.

The specific address identified in the attached petition is an individual lot with direct access to Culbreth Road.  In many neighborhoods private restrictive covenants include language regarding the parking of large vehicles, boats and trailers on residential lots.  . 

The truck which is parked on the lot is not in violation of any current Ordinance of the Town in the Town Code or in the Development Ordinance. 

If the Council wishes to consider an Ordinance regulating the types of vehicles that may be parked on residential lots we think it would appropriate to consider comments from citizens and the Planning Board before taking further action.
