SUBJECT:       Waiver of fees for Eastwood Lake Special Use Permit

 

DATE:             December 11, 2000

 

On November 13, 2000, the Council received a petition from the Lake Forest Association, requesting a waiver of fees associated with a Special Use Permit application (please see attached petition).  Adoption of the attached Resolution would authorize the waiver of development review fees for the Eastwood Lake Special Use Permit and Final Plan applications.

 

BACKGROUND

 

August 28, 2000           The Council received and referred a petition requesting that the Town either pay the cost of disposal of the Lake silt or provide a disposal site at no cost.

 

September, 2000          The Council adopted a resolution authorizing the Manager and Attorney to enter into discussions with the Lake Forest Association regarding its request for Town assistance with disposal of silt from Eastwood Lake.

 

October, 2000             Community Design Commission reviewed the Concept Plan for Eastwood Lake's Sediment Removal Project

 

November, 2000          Eastwood Lake Special Use Permit application filed.

 

In addition, we note that the Town Council has granted expedited processing of the Special Use Permit application for the sediment removal project.

 

DISCUSSION

 

Development applications within the Town's zoning jurisdiction are subject to fees associated with the type of application or permit requested (schedule attached).  The Development Review Fees schedule indicates that certain permits associated with community development programs as well as Town of Chapel Hill development applications are exempt from the fees.  The Special Use Permit application and Final Plan application fees for the sediment removal project would total $7,500.

 

We believe the Eastwood Lake sediment removal project achieves public purposes.   Eastwood Lake is an important Town recreational and aesthetic asset that will benefit from the sediment removal project.  The installation of sediment traps (fore bays) as part of the project will benefit the general condition and health of the lake, area streams and downstream properties.

 

RECOMMENDATION

 

That the Council adopt the attached Resolution waiving development review fees for the Eastwood Lake Special Use Permit and Final Plan applications.

A RESOLUTION AMENDING THE DEVELOPMENT REVIEW FEES LIST TO WAIVE THE FEES FOR SPECIAL USE PERMIT APPLICATIONS INVOLVING SEDIMENT REMOVAL AT PRIVATE RECREATION FACILITIES (2000-12-11/R-6)

 

WHEREAS, the Council of the Town of Chapel Hill has received a request from the Lake Forest Association to waive the fees associated with the Eastwood Lake Special Use Permit application; and

 

WHEREAS, the Town Council has determined that Eastwood Lake is an important Town recreational and aesthetic asset that will benefit from the sediment removal project; and

 

WHEREAS, the Town Council has determined that the sediment removal project proposed would achieve public purposes;

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Town Manager is hereby authorized to waive the development review fees associated with the Eastwood Lake Special Use Permit application and Final Plan application.
