SUBJECT:            Durham-Chapel Hill Work Group Resolution of Cooperation

 

DATE:            March 5, 2001

 

The attached resolution A would adopt a revised Resolution of Cooperation for the Durham-Chapel Hill Work Group.

 

Resolution B would adopt a revised Resolution of Cooperation as approved by the Orange County Board of Commissioners.

 

BACKGROUND

 

The Durham-Chapel Hill Work Group was established in 1990 to enhance communication between elected officials in Durham and Chapel Hill.   The Work Group has met bi-monthly since that time, and recently began meeting quarterly.   We serve as Chapel Hill’s representatives to the Work Group.

 

In recent meetings, the Work Group members have discussed revisions to the original Resolution of Cooperation establishing the Work Group, and have requested each jurisdiction to review and approve it.

 

DISCUSSION

 

The existing Agreement has provided an informal mechanism for local governments to share information related to land use planning issues which cross county lines, particularly in areas between Chapel Hill and Durham.

 

The proposed revisions would add Orange County formally to the Work Group.  Orange County has participated informally for a number of years.  The revisions also update the list of issues of common concern attached to the Agreement to add water resources issues.  Please see Attachment 1 for the proposed revised Resolution of Cooperation as discussed by the Work Group.

 

On February 20, 2001, the Orange County Board of Commissioners reviewed the proposed revision, and made wording changes to the document.  Attachment 2 contains wording as approved by the Orange County Board of Commissioners on February 20, 2001.

 

Attachment 3 provides the historical record relating to Council’s review of the original Resolution of Cooperation in 1990.

 

We note that the Work Group has invited Chatham County, Hillsborough, and Carrboro elected officials to attend the meetings, starting with the December, 2000 Work Group meeting.  The Work Group has discussed continuing their participation on an informal basis for the present, and leaving open the possibility of future formalization of the arrangement.

 

RECOMMENDATION

 

We recommend that the Council consider adoption of Resolution A approving a revised Resolution of Cooperation as proposed by the Work Group (Attachment 1).

 

Resolution B would adopt a revised Resolution of Cooperation as approved by the Orange County Board of Commissioners.

WHEREAS, the City of Durham, Durham County and Chapel Hill established a discussion group to enhance communication among elected officials of Durham and Chapel Hill; and

 

WHEREAS, Orange County has been participating informally in these discussions; and

 

WHEREAS, the Work Group recommends that the respective jurisdictions update the original Resolution of Cooperation;

 

NOW, THEREFORE BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council hereby adopts the revised “Resolution of Cooperation” included as Attachment 1 to this memorandum.

NOW, THEREFORE BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council hereby adopts the revised “Resolution of Cooperation” as approved by the Orange County Board of Commissioners included as Attachment 2 to this memorandum.
