SUBJECT:            Cleland Drive Right-of-way

The attached resolution would authorize the Town Manager to proceed with the steps needed to resolve issues with the University of North Carolina related to the Cleland Drive right-of-way and the BellSouth PCS antenna.

 

BACKGROUND

 

On February 7, 2001, the Town Manager met with Nancy Suttenfield, UNC-CH Vice Chancellor for Finance and Administration, to discuss the issues related to the Cleland Drive right-of-way and the BellSouth PCS antenna.

 

As a result of that conversation, representatives of the Town and the University announced that an agreement had been reached for resolving issues related to rental income for the BellSouth PCS antenna and the status of the Cleland Drive right-of-way.

 

DISCUSSION

 

Under the agreed to terms, the University will take the necessary steps to formally dedicate the Cleland Drive right-of-way and will receive the rental income for the BellSouth PCS antenna from April 17, 2000 (the time when the University first formally raised the issue of the disputed right-of-way with the Town) until the formal dedication is made.  We would expect the completion of these steps within the next few months.  Other revenues for rental of the site by BellSouth PCS are to go to the Town. 

 

As agreed to by the Manager, the surveying work necessary for the right-of-way to be dedicated has been completed by Town staff.  In the course of completing the surveying work, our staff determined that some of the right-of-way for Hamilton Drive in this area does not match up with the actual location of the street.  Thus, the attached plat proposes the adjustment of the Hamilton Drive/Cleland Drive intersection in addition to the dedication of the right-of-way for Cleland Drive from Fordham Boulevard to that point east of Hamilton Drive where it would connect with the previously dedicated portion of Cleland Drive.  The right-of-way for Cleland Drive is 60 foot in width and will include the area of the site of the BellSouth PCS antenna.

 

 

RECOMMENDATION

 

That the Council adopt the attached resolution authorizing the Manager to take the necessary steps to complete the settlement of this matter with the University of North Carolina.

A RESOLUTION AUTHORIZING THE MANAGER TO TAKE STEPS TO RESOLVE ISSUES RELATED TO THE CLELAND DRIVE RIGHT-OF-WAY (2001-03-05/R-9)

 

BE IT RESOLVED by the Council of the Town of Chapel Hill that the Town Manager is hereby authorized to complete the steps needed to resolve matters with the University of North Carolina in accordance with the terms contained in his report to the Council on March 5, 2001.
