SUBJECT:            Donation of Property in the Dry Creek Greenway Corridor

The attached resolution would accept a donation of approximately 2,073 square feet of property in the Dry Creek greenway corridor.

 

BACKGROUND

 

The Town has acquired much of the Dry Creek greenway corridor from East Chapel Hill High School to the Eastowne development. Additional land acquisition efforts are underway along the Dry Creek corridor north of I-40.

 

DISCUSSION

 

In 1999, the original developer of the Notting Hill Apartment complex (then known as Sterling Ridge) deeded to the Town 8 acres of property adjacent to Dry Creek. They have since sold the project. However, they recently discovered that they have inadvertently retained title to a narrow strip of land adjoining the 8 acres that is now owned by the Town.

 

They propose to deed this 2,073 square foot property to the Town. Please see the attached map. We believe that it makes sense for the Town to own this property. It is adjacent to the existing 8-acre tract that is currently owned by the Town. The property could be included as part of our Dry Creek greenway and open space holdings.

 

The only cost to the Town would be recordation fees of less than $50.

 

Manager’s Recommendation: We recommend that the Council adopt the attached resolution accepting the donation of approximately 2,073 square feet of property in the Dry Creek greenway corridor.

A RESOLUTION ACCEPTING THE DONATION OF APPROXIMATELY 2,073 SQUARE FEET OF PROPERTY IN THE DRY CREEK GREENWAY CORRIDOR (2001-04-09/R-3)

 

WHEREAS, Sterling Apartments LLC have offered to donate approximately 2,073 square feet of property to the Town; and

 

WHEREAS, the offered property would allow expansion of the Dry Creek greenway corridor and open space;

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council hereby accepts the donation of approximately 2,073 square feet of property, described in Orange County Deed Book 1740, Page 357, from Sterling Apartments LLC.
