SUBJECT: Follow-Up for Mayor’s Committee on University Discussions Regarding Implementation of New Zoning

The attached resolution would endorse proposals made in the April 18 letter to Chancellor James Moeser and in the April 18 paper that I presented at the last meeting of the Town and University discussion group.
On April 18, members of the Mayor’s Committee on University Discussions met with Chancellor James Moeser and University representatives to discuss new ways for the Town and the University to work together on development and fiscal issues. At the meeting, we presented the attached documents:

Attachment 3 is the presentation that I made last Wednesday, April 18, and includes a proposed timetable for University discussions, with three outcomes that I suggested were desirable. The Chancellor accepted these three proposals, and I ask that the Council endorse them, also. Specifically, I propose that:
This proposed time frame for action is very aggressive. In order to achieve the products on time, the Manager and his staff will need to make this work a top priority for the next 60 days. This needs to be accomplished during the same time period that we are developing a budget for next fiscal year and in the time that we had set aside for intensive work to prepare a new draft Development Ordinance. Both need to go forward. This proposed time frame would have both the draft Development Ordinance and consideration of the University-related actions come to our Planning Board on June 5, and to a Council Public Hearing on June 18. Accordingly, work on other projects would need to be deferred. Acceptance of this timeline carries with it acceptance of the fact that our Manager and staff will need to adjust priorities. For example, a development application that had tentatively been scheduled for the June 18 Public Hearing would need to move to September.
I believe that this University-related work is critically important, and that deferral of work on other projects is a reasonable trade-off.
I request that the Council adopt the attached resolution, endorsing proposals made in the April 18 letter to Chancellor James Moeser and in the April 18 Mayor’s paper presented at the last meeting of the Town and University discussion group.
A RESOLUTION ENDORSING PROPOSALS MADE IN THE APRIL 18, 2001 LETTER TO CHANCELLOR JAMES MOESER AND IN THE APRIL 18, 2001 PAPER PRESENTED BY MAYOR ROSEMARY WALDORF (2001-04-23/R-14)
WHEREAS, members of the Mayor’s Committee on University Discussion met with representatives of the University of North Carolina at Chapel Hill on April 18, 2001, to discuss new ways for the Town and the University to work together on development and fiscal issues; and
WHEREAS, the Mayor presented a letter to the Chancellor with a discussion paper explaining a new “Development Plan” option in Chapel Hill’s proposed Office/Institutional-4 Zoning District and a discussion paper proposing a schedule for considering and implementing a proposed Office/Institutional-4 Zoning District; and
WHEREAS, the Mayor presented a “Statement of Mayor Rosemary I. Waldorf,” which outlined a timetable and specific Town goals regarding University discussions;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council: (1) authorizes Town and University staff representatives meet to discuss details of the proposed OI-4 zone and process; (2) authorizes the Mayor and Manager to meet with the Chancellor and Vice Chancellor for Business and Finance to discuss fiscal issues; (3) endorses the proposed schedule of action.

April 18: Meeting between Mayor’s Committee and Chancellor
April 23: Town Council decision to pursue this timeline. Council calls a Public Hearing for June 18 to consider amending the Development Ordinance to create a new OI-4 zone, and amending the Zoning Atlas to apply this new zoning district to the UNC Central Campus (to those areas currently zones OI-3).
April 24: University begins preparing a Development Plan for part of the Central Campus, preparing information as outlined in the Town Council’s proposal for the OI-4 zoning district.
Town staff and University staff initiate a collaborative effort to prepare a draft OI-4 zoning district and statement of the elements of an application to be filed by the University.
Chancellor and Mayor initiate meetings to discuss fiscal issues.
May 24: Meeting between Mayor’s Committee and Chancellor to review draft OI-4 zoning district proposal.
May 31: Draft for OI-4 district completed, sent to Planning Board along with proposal to rezone land from OI-3 to OI-4.
June 5: Planning Board meeting.
June 18: Council Public Hearing, to consider draft OI-4 district, rezoning proposal for Central Campus, and proposals related to fiscal issues.
July 2: Council Action to create OI-4, and rezone Central Campus to OI-4.
July 3: University submits Development Plan
September 4: Planning Board reviews Development Plan
September 19: Council Public Hearing on Development Plan
October 1: Council acts on Development Plan
October 2: University submits application for Zoning Compliance Permit for first building(s) covered by Development Plan
October 23: Town Manager issues final approval for first building(s)
