SUBJECT:            Rescheduling a Public Hearing on the Development Ordinance for June 20, 2001

The attached resolution would reschedule a Public Hearing on a proposed revision of Chapel Hill’s Development Ordinance.  The draft Development Ordinance is currently scheduled to be considered at the Council’s June 18 Public Hearing, along with other items.  The attached resolution would set aside one evening, June 20, exclusively for discussion of the draft.

 

BACKGROUND

 

The Town Council scheduled a Public Hearing for June 18 to review a first draft of a revised Development Ordinance.  This draft is being structured along the lines of an outline presented to the Council by the Town’s consultant, Mr. Mark White of Freilich, Leitner, & Carlisle, on April 18, 2001. 

 

June 18 will be a full evening.  The plan was to have Mr. White present the draft Development Ordinance, and we anticipate comments by advisory boards and citizens.  Also scheduled for Public Hearing on June 18 is a proposed new zoning district that could be applied to University property, and a rezoning proposal for the central campus of UNC.  Both of those items are likely also to be the subject of advisory board and citizen comments.  We believe that there would likely not be sufficient time for Council members to offer feedback to Mr. White on the draft Development Ordinance on June 18, with the full agenda.  Council feedback is critical, however, to assuring that the next draft of the Development Ordinance (which would be prepared over the summer) matches Council expectations. 

 

In addition we have learned that Mr. White has a conflicting obligation on June 18.  These facts together lead us to recommend scheduling an additional evening of discussions, June 20, to focus exclusively on the Development Ordinance.

 

PROPOSAL FOR ADDITIONAL PUBLIC HEARING EVENING

 

We suggest leaving the proposed new zoning district for University property, and the rezoning proposal for central campus, on the June 18 Public Hearing calendar.  We recommend that the Council then schedule an additional Public Hearing, for June 20, to consider the draft Development Ordinance.  Advisory board and citizen comments on the draft Development Ordinance would be scheduled for this same night, June 20.  (Note:  A session has been scheduled on May 29, 2001, with members of eight Town advisory boards invited to come and hear a presentation on the draft, and participate in a question and answer session to help boards and commissions be in a position to offer comments to the Council.)

 

We recommend adoption of the attached resolution which would schedule a Public Hearing on the draft Development Ordinance for June 20, 2001.


 

A RESOLUTION AMENDING THE 2000-2001 COUNCIL CALENDAR TO SCHEDULE A PUBLIC HEARING ON THE DEVELOPMENT ORDINANCE (2001-05-07/R-6)

 

WHEREAS, the Council wishes to hold a Public Hearing on a proposed revision of Chapel Hill’s Development Ordinance; and

 

WHEREAS, June 20, 2001, 7:00 p.m. has been suggested as a possible meeting date and time;

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council hereby amends its 2000-2001 meeting calendar to schedule a Public Hearing for Wednesday, June 20, at 7:00 p.m., in the Council Chamber of Town Hall, for the purpose of considering a proposed revision of Chapel Hill’s Development Ordinance.
