SUBJECT:       Technical Correction to Town Code:  Erosion Control Ordinance

The attached Ordinance would make a technical correction to the Town Code.

 

DISCUSSION

 

Section 5-97, Paragraph (f) provides that where erosion control plans are required, they be approved prior to issuance of a building permit.  The stated authority for the provision in the code, North Carolina General Statute Section 153A-357, is incorrect.  The correct reference is North Carolina General Statute Section 160A-417.

 

RECOMMENDATION

 

That the Council adopt the proposed technical correction. 

 

 

AN ORDINANCE MAKING A TECHNICAL CORRECTION TO SECTION 5-97 OF THE CODE OF ORDINANCES (2001-08-27/O-3)

 

BE IT ORDAINED by the Council of the Town of Chapel Hill as follows:

 

Section 1. Section 5-97, Paragraph (f) of the Town Code is hereby revised to read as follows:

 

“(f)  Pursuant to G.S. Section 160A-417 153A-357, no building permit shall be issued unless an erosion control plan has been approved, where such approval is required, for the site of the activity or a tract including the site of the activity.

 

Section 2.  This ordinance shall become effective upon adoption.
