SUBJECT:     Schedule for Considering Petition to Rezone Parcel at South Columbia Street and Old Pittsboro Road

Adoption of the attached resolution would re-schedule a May 20, 2002, hearing on a petition to rezone a 0.8-acre tract at the corner of South Columbia Street and Old Pittsboro Road.

 

BACKGROUND

 

On November 26, 2001, the Town Council scheduled a Public Hearing for May 20, 2002, to consider rezoning a parcel of land at the corner of South Columbia Street and  Old Pittsboro Road.   The parcel is owned by the University of North Carolina at Chapel Hill and is zoned Office Institutional-3.  The Council called a hearing to rezone the parcel to Residential-2.  A copy of the November 26 memorandum describing this situation is attached.

 

On January 28, the Town Council adjusted the calendar of public hearings for the first half of 2002 to place emphasis on consideration of a proposed new Development Ordinance.

 

DISCUSSION

 

The Town Council has indicated intent to focus attention during scheduled March, April, and May Public Hearings on the proposed 2nd Draft of the new Development Ordinance.  We believe it is desirable to devote full attention those evenings to the proposed new regulations.  The June hearing has been reserved for consideration of development applications with expedited processing status that were not able to be heard earlier.  The September hearing has been reserved for review of an expected 3rd Draft of the new Development Ordinance.

 

Accordingly, we believe that it would be reasonable and desirable to shift consideration of rezoning this Old Pittsboro Road parcel to October, 2002, after the Council has completed work on the new Development Ordinance.  We know of no plans for use of this parcel, and there is no pending application for development of this parcel.  We believe that the schedule adjustment would not impair the Council’s ability to move forward with this rezoning if it chooses to do so.


 

RECOMMENDATION

 

We recommend that the Council adopt the attached resolution, rescheduling this public hearing.

A RESOLUTION RE-SCHEDULING A HEARING ON REZONING PETITION (2002-02-11/R-5.1)

 

WHEREAS, on November 26, 2001, 22, the Chapel Hill Town Council called a hearing for May 20, 2002, to consider a proposal to rezone a parcel at South Columbia Street and Old Pittsboro Road (Tax Map Number 7.88.H.1) from Office Institutional-3 to Residential-2; and

 

WHEREAS, the Council intends to focus discussion at the May 20, 2002 hearing on proposed changes to the Chapel Hill Development Ordinance;

 

NOW, THEREFORE BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council re-schedules this public hearing from May 20, 2002, to October 16, 2002, at 7 p.m. in the Council Chamber, Town Hall, 306 N. Columbia Street.

Adoption of the attached resolution would schedule a May 20, 2002, hearing on a petition to rezone a 0.8-acre tract at the corner of South Columbia Street and Old Pittsboro Road. The petition requests that the lot be rezoned from Office Institutional-3 to Residential-2.

 

BACKGROUND

 

On June 18, 2001, the Town Council held a hearing on the proposed zoning of University of North Carolina properties on the main campus and on the campus edge to Office Institutional-4. At that time, a resident of the adjoining Westwood neighborhood, Mr. Joe Capowski, told the Council that he would later petition the Council to rezone a University-owned parcel at the corner of South Columbia Street and Old Pittsboro Road to Residential-2. The lot was not considered in the Office Institutional-4 rezoning process. He noted that Residential-2 zoning is the predominant zoning in the area. Mr. Capowski also noted that the Town’s Land Use Plan states that this area should be low-density residential. 

 

DISCUSSION

 

On October 22, 2001, Mr. Capowski submitted to the Town Council a petition to rezone the parcel (Tax Map Number 7.88.H.1) as indicated on Map 1 from Office Institutional-3 to Residential-2. We propose the following schedule for considering the rezoning petition:

 

·        April 5, 2002          Notification to Property Owners

·        April 16, 2002        Planning Board review

·        May 20, 2002        Council Public Hearing

·        June 10, 2002        Council consideration

 

RECOMMENDATION

 

We recommend the Council consider the attached resolution scheduling a hearing on the rezoning petition for May 20, 2002.
