Third Draft: Proposed Land Use Management Ordinance

Inventory of Ideas
There have been many ideas
suggested for improving the proposed new Land Use Management Ordinance. Some
of the ideas raise major policy issues; these are highlighted in the Manager’s
Memorandum to the Council for tonight’s Public Hearing. Others would serve to
clarify the language of the ordinance and improve readability; and there is a
need for adjusting numbering, cross-references, eliminating duplicative
language, and correcting typographical errors.
This attachment summarizes ideas
that have been suggested, in addition to those discussed in the Manager’s
memorandum. We intend to forward these ideas to the consultant for
incorporation as a Final Draft is prepared.
- Include, in the Access and
Circulation section, reference to the requirement for preparation of a
Traffic Impact Analysis as a component of an application for a major
development.
- Adjust the Purpose Statement of
the Comprehensive Plan section to clarify the link between the
Comprehensive Plan and the Land Use Management Ordinance.
- Eliminate duplicative and/or
redundant text in several sections.
- Explanatory statements are
needed to clarify intent of applying impervious surface ratios. Example:
clarify that such ratios apply to Net Land Area of a lot, not Gross Land
Area.
- Delete reference to “shrubs” in
Tree Protection regulations.
- Change reference to “Major
Street Plan” in Section 6.16.6 to “Thoroughfare Plan.”
- In definition of Transit
Station, change reference to “rail” to a more generic term for
fixed-guideway transit.
- Clarify, in the definition of
Woodlands, that the definition pertains to “significant”
- Change all uses of the word
“he” in reference to the Manager to something more gender-neutral (e.g.,
“he/she”).
- Add clarifying examples of what
kinds of changes to access and circulation would be considered
“substantial,” for purposes of reviewing proposed changes to Special Use
Permits and Site Plans.
- Expand the watershed
regulations to allow engineered stormwater controls by methods other than
wet detention ponds if deemed acceptable by the State.
- Clarify that the zoning
designation conferred by a Conditional Use rezoning will expire (such that
property reverts to former zoning) if a Special Use Permit associated with
that Conditional Use Zoning expires.
- Remove references to
connectivity, a concept that has now been removed from the ordinance.
- Clarify organization of Tree
Protection regulations to improve readability.
- Eliminate conflicting language
within sign regulations.
- Add Section Numbers to the
headers of each page.
- Change all references to
“Development Ordinance” to “Land Use Management Ordinance.”
- Adjust formatting of Table
3.7-1, Use Matrix, to improve clarity.
- Adjust footnote to “Impervious
Surface Ratio” footnote, associated with Table 3.8-1 (Dimensional Matrix)
to reflect decisions the Council makes on this issue.
We expect additional ideas and
suggestions to be offered, and will incorporate as they are received.
