SUBJECT: Acceptance of State Funds for Street and Drainage Improvements

The attached resolutions would authorize the Town Manager to execute two municipal agreements to accept State funds for street and drainage improvements on State roads in Chapel Hill.
The Manager recommends adoption of the resolutions.
BACKGROUND AND DISCUSSION
In response to a request submitted by the Town last year, our State Transportation Board Member Mr. Doug Galyon has agreed to make $100,000 available to the Town for street and drainage improvements on Airport Road and Franklin Street in Chapel Hill. The Town is not required to provide any matching funds to receive this money.
The $100,000 is allocated to the Town in two portions; $60,000 for work on East Franklin Street and $40,000 for work on Airport Road (NC 86). Therefore, two municipal agreements will need to be executed to receive the total $100,000. Our request for State funding assistance includes both specified small projects and unspecified drainage and curb and gutter improvements as outlined below.
· Construct curb extension (bulb-out) at the intersection of Stevens Street and Airport Road
· Reconstruct the Park Place intersection at East Franklin Street
· Renovate storm drains and curb/gutter at various locations on East Franklin Street
· Widen the Battle Lane intersection at East Franklin Street
Additional unspecified projects can be undertaken if funds remain following completion of the work listed above.
We anticipate that the improvements would be completed primarily with contract services, supplemented by Town forces where appropriate. All costs (contract and Town) would be documented and submitted to the State for reimbursement in accordance the Municipal Agreements.
MANAGER’S RECOMMENDATION
That the Council adopt the attached resolutions authorizing the Manager to execute Municipal Agreements with the State to accept funds for street and drainage improvements on State Roads in Chapel Hill.
A RESOLUTION AUTHORIZING THE TOWN MANAGER TO EXECUTE A MUNICIPAL AGREEMENT WITH THE STATE FOR $60,000 TO PERFORM STREET AND DRAINAGE IMPROVEMENTS ON STATE ROADS IN CHAPEL HILL UNDER STATE PROJECT #9.8070385 (2002-11-11/R-4a)
WHEREAS, the North Carolina Department of Transportation and the Town of Chapel Hill desire improvements within the Town under State Project #9.8070385 (Orange County) consisting of street and drainage improvements at various locations along SR 1010 (East Franklin Street) in Chapel Hill; and
WHEREAS, the Town of Chapel Hill agrees to prepare, provide and/or obtain any necessary environmental/planning documents, permits, plans, specifications, estimates, rights-of-way, municipally owned utility relocations/adjustments, contract awards, and project supervision; and
WHEREAS, the Department agrees to participate in the actual construction costs of the improvements in an amount not to exceed $60,000;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that Project #9.8070385 is hereby approved and that the Town Manager and Town Clerk are hereby authorized to sign and execute a Municipal Agreement with the North Carolina Department of Transportation for said project.

WHEREAS, the North Carolina Department of Transportation and the Town of Chapel Hill desire improvements within the Town under State Project #9.8070386 (Orange County) consisting of street and drainage improvements at various locations along NC 86 (N. Columbia Street/Airport Road) in Chapel Hill; and
WHEREAS, the Town of Chapel Hill agrees to prepare, provide and/or obtain any necessary environmental/planning documents, permits, plans, specifications, estimates, rights-of-way, municipally owned utility relocations/adjustments, contract awards, and project supervision; and
WHEREAS, the Department agrees to participate in the actual construction costs of the improvements in an amount not to exceed $40,000;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that Project #9.8070386 is hereby approved and that the Town Manager and Town Clerk are hereby authorized to sign and execute a Municipal Agreement with the North Carolina Department of Transportation for said project.
