SUBJECT:       Chapel Hill Tire Petition Response

INTRODUCTION

 

This report responds to a petition presented at the October 21, 2002 Town Council meeting regarding a pending Site Plan Review application. 

 

DISCUSSION

 

On October 21, 2002, the Town Council received a petition from Mr. Thomas Higgins.  The petition requested, on behalf of the property owner, that a pending Site Plan Review application for a new Chapel Hill Tire at Timberlyne Shopping Center be reviewed under the provisions of the current Development Ordinance.  Enactment of the new Land Use Management Ordinance is possible as early as January 6, 2003.  We note that the Town Council has provided direction that applications for which Site Plan Review approval has occurred prior to enactment of the new regulations have a special status and may proceed with development under the terms of the Planning Board approval. 

 

The Site Plan Review application, which proposes the new location of a Chapel Hill Tire facility on an out-parcel at Timberlyne Shopping Center, is scheduled for review by the Planning Board on December 3, 2002.  Action on the application by the Planning Board may occur that evening.  The Planning Board has 35 days to take action on the application.  Subsequent Planning Board meeting dates, within the 35 day review period, are December 17 and January 7.   

 

Given the anticipated review schedule for the Chapel Hill Tire application, we anticipate that action by the Planning Board is possible prior to the scheduled January 6, 2003 enactment of the Land Use Management Ordinance. However, it is also possible that action by the Planning Board may not occur until January 7.
