SUMMARY MINUTES OF A CLOSED SESSION
OF THE CHAPEL HILL TOWN COUNCIL
WEDNESDAY, OCTOBER 11, 2000, AT 9:14 P.M.
Mayor Rosemary Waldorf called the closed session to order at 9:14 p.m.
Council members present were Flicka Bateman, Joyce Brown, Pat Evans, Bill Strom, Jim Ward, and Edith Wiggins. Council Member Kevin Foy and Mayor pro tem Lee Pavão were absent, excused.
Staff members present were Town Manager Cal Horton, Assistant Town Managers Sonna Loewenthal and Florentine Miller, Town Attorney Ralph Karpinos, Assistant to the Manager Bill Stockard, and Town Clerk Joyce Smith.
Mr. Karpinos provided a brief overview of a trial involving Police Officer Melvin Smith regarding work he performed as a notary public.
The details from this discussion are being withheld pending further review by
the Town Attorney.
Mr. Karpinos stated that Attorney Susan Burkhart has been assigned by the League insurance program to defend this case, and he was in the process of putting together a file for her and would meet with her in the next week or so.
Mr. Karpinos said that, regarding the Board of Adjustment case, there was a good chance that this variance denial will be upheld but that eventually some use will be allowed on this property. He asked if this property was of any interest to the Council as a pocket park. No interest was indicated by the Council. Mr. Karpinos said we have filed our response to the petition and listed several defenses. He said it is a question primarily of whether the Board of Adjustment had sufficient evidence to deny the application. Mr. Karpinos said if the applicant loses he may reapply and may find a way to site a house on this lot, probably a smaller house, or may just walk away. Mr. Karpinos said if there were any significant changes, he would notify the Council.
