A RESOLUTION DECLARING A 2002 MACK MV323 FREEDOM-XXL GARBAGE TRUCK AS SURPLUS PROPERTY AND AUTHORIZING AND DIRECTING THE DISPOSAL OF SAID PROPERTY IN ACCORDANCE WITH STATUTORY REQUIREMENTS (2005-11-21/R-5)

WHEREAS, Chapter 160A, Article 12 of N. C. General Statutes and Section 4-16 of the Charter of the Town of Chapel Hill authorizes the Town to dispose of surplus property; and

WHEREAS, the Town desires to dispose of a 2002 Mack MV323 Freedom-XXL garbage truck at an on-line public auction scheduled for Monday, November 28 through December 9, 2005;

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the 2002 Mack MV323 Freedom-XXL garbage truck is hereby declared surplus.

BE IT FURTHER RESOLVED that the Purchasing Coordinator of the Town of Chapel Hill shall be and is hereby authorized to dispose of this surplus personal property in accordance with statutory requirements and the following terms:

The sale shall be to the highest bidder for cash or other forms of cash equivalents acceptable to the Purchasing Coordinator.  The sale shall be designated final on the closing day of the auction.

This item shall be sold on an “as is” and “where is” basis and the Town makes no guarantee or assumes no responsibility for this item.
