PURPOSE

The purpose of this memorandum is to present to the Council the results from a poll of the Coker Hills neighborhood regarding a proposed Neighborhood Conservation District rezoning. 

The attached resolution would schedule a public hearing for September 17, 2007 to receive citizen comments on a proposed Neighborhood Conservation District rezoning for the Coker Hills neighborhood. 

BACKGROUND

On March 20, 2007, the Planning Board received the first version of the Coker Hills Consensus Committee Neighborhood Conservation District Proposal. The Planning Board also received the staff response to the first version of the proposal at that meeting.   On March 27, 2007, the Coker Hills Consensus Committee submitted a revised proposal, which was also sent to property owners included in the proposed boundary (see Attachment 1).

On April 3, 2007, after receiving comments from residents in support and against the proposal submitted by the Consensus Committee, the Planning Board recommended that the Council direct the Town Manager to poll the effected households to determine if there is at least 51 percent support for a Neighborhood Conservation District in the Coker Hills neighborhood as proposed by the Consensus Committee (please see Attachment 2).   On April 11, 2007, the Council adopted a resolution directing the Manager to proceed as recommended by the Planning Board (please see Attachment 3). 

DISCUSSION

On May 15, 2007, we mailed a ballot to all 129 property owners within the proposed boundary.  The mailing included the Neighborhood Conservation District rezoning proposal developed by the Coker Hills Consensus Committee.  The ballot provided the Committee’s recommendations as well as a space to indicate if a property owner supported or opposed the proposal.  Each property received one ballot.   We informed residents that in order for their vote to be tallied for the Planning Board’s June 5, 2007 meeting, it had to be received in our office by 5:00 p.m. on Monday, June 4, 2007.  A pre-addressed, stamped envelope was provided with each ballot.  

Results of the Neighborhood Poll

As of June 4, 2007, of the 129 ballots sent, we received a total of 86 ballots: 62 (72 percent) in support of the proposed Neighborhood Conservation District rezoning, and 24 (28 percent) opposed to the proposal.   

RECOMMENDATIONS

Planning Board Recommendation:  On June 5, 2007, the Planning Board voted 8-1 to recommend that the Council amend the Chapel Hill Zoning Atlas to create a Neighborhood Conservation District for the Coker Hills neighborhood.  Please see Attachment 5 for a summary of the Planning Board’s action.

Staff Recommendation:  We recommend that the Council adopt the attached resolution scheduling a public hearing for September 17, 2007.
