PURPOSE

 

Tonight, the Council continues the Fairway Hill Subdivision Public Hearing from November 20, 2006.  The purpose of this cover memorandum is to forward the Town Manager’s recommendation to the Council for the proposed development.  The proposal would subdivide 5.1 acres into four lots.  The site is located on the east side of Pinehurst Drive between Burning Tree Drive and Driskel Court.  Details are included in the attached memorandum.

 

DISCUSSION

 

At the November 20 Public Hearing, the Council directed staff to return with a revised resolution that would approve the subdivision with the proposed street alignment through the middle of the site, as originally proposed during the Concept Plan review.  The applicant’s current proposal includes a roadway alignment near the southern property line.

 

Based on discussions with the Town Attorney, we believe that the Council could stipulate a road alignment through the middle of the site only if the applicant agrees to amend the application and realign the roadway.  Town staff has been working with the applicant to resolve the alignment issue.  As of tonight’s meeting, the applicant is not agreeable to this change.  Therefore, we recommend Revised Resolution A, with the road alignment as proposed by the applicant.  If the Council desires to pursue an alternate roadway alignment with the applicant, the attached memorandum includes additional information on this option.

 

Also at the November Public Hearing, a citizen spoke of concerns about impacts on existing residences, particularly vehicle headlights shining onto adjacent properties.  The applicant has offered to provide additional landscaping along the southern property line to address this issue.  Revised Resolution A includes a stipulation requiring this buffer area as offered by the applicant.

 

MANAGER’S RECOMMEDATION

 

The Town Manager has reviewed and discussed the key issues with the Town staff.  Based on the information in the record to date, the Town Manager’s recommendation is that the Council adopt Revised Resolution A, approving the application with conditions.
