PURPOSE

 

Attached is a proposal for Concept Plan review for the 1609 East Franklin Street property. The Council has the opportunity tonight to hear this applicant’s presentation, receive a set of comments from the Community Design Commission, hear public comment, and offer suggestions to the applicant for consideration as further plans are drawn.  At the conclusion of the evening’s discussion, we recommend that the Council adopt a resolution (Attached) transmitting comments to the applicant.

 

PROJECT DESCRIPTION

 

This Concept Plan proposal involves construction of an office and retail development.  The proposed project is located on the north side of East Franklin Street, between Elliott Road and the Ballet School. A portion of the site includes frontage on Velma Road (see area map – Attachment 3). The proposed project includes 18,500 square feet of floor area and 59 on-site parking spaces. The 1.9-acre site is located in Orange County, in the Residential–1 (R-1) and the Residential-5 (R-5) zoning districts.

 

BACKGROUND

 

October 11, 1999

The Town Council approved a Special Use Permit for 1609 East Franklin Street, an office development with one building and 59 parking spaces  A total of 18,301 square feet of floor area was authorized (of that total, a maximum of 4,850 square feet of commercial space was allowed). The Special Use Permit included a construction start date of October 11, 2001. A rezoning from Residential-1 and Residential-5 to Neighborhood Commercial-Conditional was also approved.    

 August 9, 2001

The Town Manager granted a twelve (12) month extension of the construction start date. 

September 11, 2002

A Zoning Compliance Permit was issued for Phase 1 and shortly thereafter work began on demolition of a structure on the site.

September 23, 2002

The Town Manager, in accordance with Article 18.6.3 of the Development Ordinance, granted a second twelve (12) month extension of the completion date.  The new completion date was at that time revised to October 11, 2003.

September 8, 2003

The Town Council adopted a resolution approving a request to extend the completion construction date to October 11, 2004.

Post October 11, 2004

Since the October 11, 2004 completion construction date was not further extended and work was not completed, zoning of the property reverted back to pre-October 11, 1999 zoning of Residential-1 and Residential-5.

 

Section 4.4.2 (h)(3) of the Land Use Management Ordinance states that if a Special Use Permit issued for a Conditional Use District is abandoned, revoked, or becomes void, the property shall revert to its previous zoning classification. Therefore, the applicant is required to submit a Special Use Permit and a rezoning request for the application for the development.

January 24, 2007

A Concept Plan for this site was initially reviewed by the Community Design Commission. A copy of summary comments from the January meeting are attached (Attachment 1). 

The proposal reviewed by the Community Design Commission on January 24, 2007 is identical to the proposal before the Council tonight.

 

The East Franklin Street Corridor Plan, a component of the Comprehensive Plan, identifies the site for a high intensity use with a mix of uses—residential, office and limited commercial. The site is identified as Orange County Property Identifier Numbers 9799-04-6951 and 9799-04-7995.

 

This development proposal does not meet land use intensity thresholds requiring Town Council review of a Concept Plan. On January 22, 2007, Town Council authorized the applicant’s request for Concept Plan review.

 

ELEMENTS OF REVIEW

 

The Town Council and Community Design Commission, in examining development applications, are to consider the various aspects of design, with special emphasis on whether the proposed development is consistent with the Town’s Design Guidelines and the Goals and Objectives of the Town’s Comprehensive Plan.

 

The Concept Plan review process does not involve staff evaluation of the proposal. 

 

RECOMMENDATION

 

We recommend that the Council review this Concept Plan, receive comments from citizens, and adopt a resolution transmitting comments to the applicant.
